On December 3, 2017, the Criminal Investigation Agency - Ministry of National Defense issued a decision to prosecute the case, prosecute the accused, and temporarily detain Dinh Ngoc He (Ut "troc"), former Deputy General Director of Thai Son Corporation, Ministry of National Defense, for the crime of "Taking advantage of position and power while performing official duties" under Clause 3, Article 281 of the 1999 Penal Code.

During the investigation of the case, the investigation agency also discovered that Dinh Ngoc He had purchased a fake university degree and used the fake university degree to declare in his party membership and cadre records.

Dinh Ngoc He's actions have all the elements constituting the crime of "Using fake documents of agencies and organizations" as prescribed in Article 341 of the 2015 Penal Code.

Expanding the investigation of the case, the Investigation Agency has prosecuted and temporarily detained Mr. Tran Xuan Son, residing in Ward 6, Diem Dien Town, Thai Thuy District (Thai Binh Province), who was hired by Dinh Ngoc He to be the branch director of Thai Son Investment Development Joint Stock Company, Ministry of National Defense in Binh Duong;

Mr. Tran Van Lam, residing at 18/B 518 Huynh Van Chinh apartment building, Phu Trung ward, Tan Phu district (HCMC), was hired by Dinh Ngoc He to be the general director of Thai Son Investment Development Joint Stock Company, Ministry of National Defense.

Prosecution and order to prohibit leaving the place of residence for Colonel Bui Van Tiep, former Division Commander of Division 367, Air Defense - Air Force.

All three defendants were prosecuted for the crime of "Abusing position and power while performing official duties" as accomplices assisting defendant Dinh Ngoc He.

At the same time, the authorities have initiated a case and prosecuted Colonel Phung Danh Tham, General Director of Thai Son Corporation, Ministry of National Defense, for the crime of "Lack of responsibility causing serious consequences" as prescribed in Article 360 ​​of the 2015 Penal Code.
