Selling on social networks must be registered with the Ministry of Industry and Trade?

The Ministry of Industry and Trade is seeking comments on the draft Circular regulating the management of e-commerce websites and applications on mobile devices.

The draft stipulates that traders and organizations that own e-commerce websites and mobile applications that have both sales and e-commerce service functions must register with the Ministry of Industry and Trade according to regulations. For each mobile application, the notification or registration procedure will only be carried out once for different versions of the application.

Notably, organizations and individuals are not allowed to use e-commerce websites and mobile applications to trade in goods such as hunting guns and hunting bullets, sports weapons, support tools; cigarettes, cigars and other finished tobacco products; alcohol of all kinds; rare wild plants and animals, including living things and their processed parts; other goods and services that are not allowed to be sold on the Internet according to the provisions of law.

Traders setting up e-commerce websites and mobile applications to sell goods and services in the list of goods and business services subject to conditions for granting a Certificate of Eligibility for Business must publish on their websites and applications the number, date of issue and place of issue of the Certificate of Eligibility for Business for those goods and services.

At the same time, traders and organizations providing e-commerce services must be responsible for preventing and promptly removing from the website and applying information on the sale of goods and services on the list of prohibited goods and services according to the provisions of law; providing technical measures to prevent and remove from the website and applying information on the sale of counterfeit goods, fake goods, smuggled goods, goods infringing intellectual property rights and other goods and services that violate the law when detecting or receiving well-founded feedback about this information.

Regarding the management of business activities on social networks, the draft proposes that social networks that allow participants to open booths, set up branch websites to display and introduce goods or services, or have a buying and selling section on which participants can post information about buying and selling goods and services will have to register with the Ministry of Industry and Trade in the form of an e-commerce trading floor or an e-commerce trading floor application.

Websites and applications that conduct promotions for goods of other traders, organizations and individuals according to the terms of promotional service contracts in forms such as giving away goods or providing samples for customers to try without paying; selling goods at prices lower than the previous selling price, applied for a certain period of time or to a certain number of customers; other forms according to the provisions of law on promotions.
