Officially submit proposal for 9-day Lunar New Year holiday

Minister of Labor, Invalids and Social Affairs Dao Ngoc Dung has just signed a document to the Government proposing the Lunar New Year holiday schedule and swapping weekly days off on the occasion of the 2019 holiday for officials, civil servants and public employees. Accordingly, the Lunar New Year holiday of the year of the Pig (2019) will include 9 days, 2 days longer than the holiday in 2018.

The report clearly stated that in 2019, on the occasion of New Year's Day, Victory Day April 30, and International Labor Day May 1, there was a situation of 1 working day alternating between the holidays.

At the same time, for Lunar New Year, Article 115 of the 2012 Labor Code stipulates 05 days off, Article 8 of Decree No. 45/2013/ND-CP dated May 10, 2013 of the Government detailing a number of articles of the Labor Code on working hours, rest hours and labor safety and hygiene stipulates: Lunar New Year holiday is chosen by the employer: 01 day at the end of the year and 04 days at the beginning of the year or 02 days at the end of the year and 03 days at the beginning of the year.

On that basis, the Ministry of Labor, Invalids and Social Affairs proposed two options:

Option 1:Tet holiday according to the schedule "Last 2 days of Mau Tuat year and first 3 days of Ky Hoi year" andno holiday swap, civil servants and public employees will have Lunar New Year holidays from Saturday, February 2, 2019 to Sunday, February 10, 2019 (ie from December 28, Mau Tuat year to January 6, Ky Hoi year).

According to Option 1, civil servants and public employees will have 9 consecutive days off for Lunar New Year. Because the 28th day of the Lunar New Year, which is February 2, 2019, falls on Sunday, a weekly day off, civil servants and public employees will have compensatory leave on the 4th day of the Lunar New Year, which is February 8, 2018.

Option 2:1 day off before Tet, 4 days off after Tet andno swapping holidays

Accordingly, civil servants and public employees will have 9 consecutive days off from February 2, 2019 to February 10, 2019 (ie December 28, Mau Tuat year to January 6, Ky Hoi year).

According to this plan, civil servants and public employees will have 9 consecutive days off for Lunar New Year. This includes 5 days off for Tet and 4 days off every week.

The Ministry of Labor, Invalids and Social Affairs also expressed its opinion: Through the above analysis, implementing the Lunar New Year holiday schedule according to both options is appropriate because the total number of Tet holidays is 9 days. It is recommended to implement the Lunar New Year holiday schedule according to option 1 because it reduces traffic pressure in the days before Tet.

Applicable objectsIn the proposal to swap holidays, civil servants and public employees of units with weekly holidays of 02 days, Saturday and Sunday, do not apply to businesses and people in general.

At the same time, for cadres, civil servants and public employees whose normal working schedule includes Saturday, the swap will not apply, so they will still work all day on Saturday, the day they are scheduled to take off in the swap schedule, which means that the handling of administrative procedures according to Decision No. 127/2007/QD-TTg dated August 1, 2007 of the Prime Minister on organizing work on Saturdays every week to receive and handle administrative procedures will still be guaranteed. The handling of work serving businesses, workers and people will still be guaranteed.
