According to the draft resolution approving the list of works and projects requiring land recovery as prescribed in Clause 3, Article 62 of the Land Law in the province, a total land area of ​​844.5 hectares needs to be recovered to implement 215 works and investment projects.

At the meeting, participating in the review, basically agreeing with the list of works and projects requiring land recovery submitted by the Provincial People's Committee, the delegates also raised some concerns related to the authority to decide on land recovery and some works and projects that have not ensured complete procedural documents or have not been approved by the Provincial Party Standing Committee, but are still included in the list submitted for land recovery decision.

Some delegates also raised concerns about how the land recovery ratio for each construction item in the project should be divided for projects with many functions, such as urban projects including schools, kindergartens, commercial areas, housing, swimming pools, etc., so that the implementation of compensation and site clearance policies is in accordance with regulations and complications are limited.

Commenting on this content, Vice Chairman of the Provincial People's Council Hoang Viet Duong requested the Provincial People's Committee and the Department of Natural Resources and Environment, when submitting the list of projects requiring land recovery to the Provincial People's Council for decision, must ensure the principles of legal basis, compliance with the law, correct subjects and not violate approved plans or those without plans must not be included in the list.

Concluding this content, Head of the Economic - Budget Committee of the Provincial People's Council Le Hong Vinh requested the Provincial People's Committee and the agency in charge of drafting the resolution to review the list of works and projects that ensure they are within the authority of the Provincial People's Council to decide; at the same time, request to remove from the list of works and projects that do not have sufficient documents and procedures according to regulations.

For projects with many functions, the Head of the Economic - Budget Committee suggested that the Provincial People's Committee should clearly analyze the land recovery rate according to each function in the projects for appropriate implementation.

At the meeting, examining the draft resolution on converting the purpose of using rice-growing land, protective forest land, and special-use forest land to implement works and investment projects according to the provisions of Clause 1, Article 58 of the Land Law in the province; the Economic - Budget Committee of the Provincial People's Council also requested the Provincial People's Committee and the drafting unit to closely review and edit to ensure proper authority, over 10 hectares of rice-growing land and over 20 hectares of protective forest land and special-use forest land under the authority of the Government; under 10 hectares of rice-growing land and under 20 hectares of forest land are decided by the authority of the Provincial People's Council.

According to the draft resolution on converting land use purposes for projects and works submitted this time, the total area is 221.45 hectares, of which the rice land requested to be converted is 172.76 hectares, the protective forest land is 48.29 hectares, and the special-use forest land is 0.4 hectares. The total area to be recovered is to implement 141 projects and works.

Regarding the draft resolution on the division of environmental protection spending tasks in the province, the Economic - Budget Committee of the Provincial People's Council also commented on the review and proposed the Provincial People's Committee to review and advise again to ensure compliance with the provisions of Circular No. 02 of the Ministry of Finance; dividing tasks to avoid duplication among the three levels of province, district and commune, in which priority is given to spending at the commune level.

Also this morning, the Economic - Budget Committee reviewed the draft regulations on decentralization of decision-making authority in the management and use of public assets at agencies, organizations and units under the management of localities in the province; the draft resolution amending and supplementing a number of articles of Resolution No. 40/2016/NQ-HDND, dated December 16, 2016 of the Provincial People's Council regulating business registration fees in the province.
