According to the Ministry of Public Security, when arranging regular Commune Police, the Commune Police will perform the functions, tasks and powers prescribed in the Law on People's Public Security and regulations of specialized laws on security and order.

Resolution No. 22-NQ/TW dated March 15, 2018 of the Politburo "on continuing to innovate and reorganize the Ministry of Public Security apparatus to be streamlined and operate effectively and efficiently" also determined the content of arranging regular communal police forces.

If the Commune Police are arranged as a regular force, then the Commune Police Chief (with the same cadre standards as the Ward Police Chief) if structured to participate in the Standing Committee of the Commune Party Committee (similar to the Ward Police Chief being structured into the Ward Party Committee Standing Committee), will ensure the strengthening of the Party Committee's leadership over the Commune Police, at the same time, the position and role of the Commune Police will be raised (currently, the Commune Police Chief is a commune-level civil servant and is only structured to participate in the Executive Committee).

When arranging regular Commune Police, the Commune Police will perform functions, tasks and powers according to the provisions of the Law on People's Public Security and the provisions of specialized laws on security and order.

Therefore, the Ministry of Public Security believes that it is necessary to adjust the Law on People's Public Security, the Law on Cadres and Civil Servants to regulate Commune Police and the documents guiding their implementation. At the same time, it is necessary to have a plan to arrange other jobs for the current 9,339 Commune Police Chiefs (who are commune-level civil servants) in accordance with the capacity, professional qualifications and strengths of each person.

According to the Ministry of Public Security, at the grassroots level (commune, ward, town), in addition to the Ward Police, Town Police, and Commune Police, there are many mass organization models participating in protecting security and order at the grassroots level such as: Civil Defense Team, Mediation Team, Neighborhood Protection, Agency and Enterprise Protection...

When arranging the Commune Police as regular Police, we will continue to mobilize the current Police force and these organizations to participate in protecting security and order in villages, hamlets, and hamlets... Accordingly, the current Police force in the commune and the People's Protection force in the ward will be the main force supporting the Ward Police and Commune Police in performing the task of protecting security and order.

Models of mass organizations participating in protecting security and order at the grassroots level are being regulated by many different legal documents, but there is no unified regulation.

Therefore, in order to mobilize the People's Protection Force, the current part-time Commune Police and other mass organizations to participate in the work of protecting security and order, it is necessary to develop legal documents regulating the general organization and operation of these forces (it is possible to propose to the National Assembly to develop a draft Law on grassroots security forces).

To build a regular communal police force, it is necessary to amend, supplement and develop new legal documents related to the organization, operation and powers of the communal police.

Develop new legal documents on the organization and operation of semi-professional forces and self-managed mass organizations participating in protecting security and order at the grassroots level (commune-level areas).

According to Circular 17/2018 of the Ministry of Public Security regulating the equipment of weapons, military explosives, and support tools, effective from July 1, 2018, commune police will be equipped with guns.

Specifically, at Point e, Clause 1, Article 3 and Article 4 of the Circular, the police of communes, wards and towns are equipped with weapons, military explosives and support tools of the following types: pistols, rifles, submachine guns and rubber bullet guns.

Commune, ward and town police are also equipped with tear gas, electric batons, pepper spray, knife-catching gloves, body armor, electric batons, rubber batons, metal batons, figure-eight handcuffs, and various primitive weapons.
