Regulations on the authority to decide on the procurement of public assets of the Chairman of People's Committees at all levels

The Resolution stipulates the decentralization of decision-making authority in the management and use of public assets at agencies, organizations and units under local management in Nghe An province, including: office buildings and other assets attached to land; irrigation infrastructure assets; cars and other means of transport; machinery and equipment; intellectual property rights, application software, databases and other assets as prescribed by law.

In particular, regarding the authority to decide on the procurement of public assets in cases where it is not necessary to establish an investment project, the Resolution stipulates:

Regarding the authority to purchase automobiles and other means of transport: The Chairman of the Provincial People's Committee decides to purchase new automobiles for work, specialized automobiles, and waterway vehicles with a capacity of 100 CV or more upon the request of the Director of the Department of Finance. Regarding automobiles for work and specialized automobiles, the Chairman of the Provincial People's Committee decides after receiving the consensus of the Standing Committee of the Provincial People's Council.

Regarding the authority to decide on the purchase of assets such as machinery, transmission equipment, working equipment and other assets (except cars and means of transport), the Resolution stipulates:

The Chairman of the Provincial People's Committee decides to purchase assets of agencies, organizations and units with a value of 300 million VND or more/unit of asset or a purchase value of 500 million VND or more/one purchase including many types of assets.

Heads of provincial departments, branches, organizations, and units; chairmen of district-level People's Committees decide to purchase assets (except cars and means of transport) at the request of the Department of Finance - Planning, Department of Finance - Accounting or departments and units with the function of state management of finance and assets according to the provisions of law with a purchase price of less than 300 million VND/unit of asset or a total purchase value of less than 500 million VND/purchase of many types of assets.

Heads of agencies and units under provincial departments, branches and sectors, under district-level People's Committees, heads of district-level organizations and chairmen of commune-level People's Committees decide to purchase assets with a purchase price of less than VND 100 million/unit of asset or a total purchase value of less than VND 150 million/purchase of multiple types of assets.

For programs and projects, procurement shall be carried out in accordance with State regulations on such programs and projects...

In addition to purchasing public assets, the Resolution also regulates the management and use of public assets at agencies, organizations, and units that are assigned the authority to decide on the following contents: Lease of assets and lease of the right to exploit irrigation infrastructure assets; Recovering public assets; Transferring public assets; Selling public assets; Liquidating public assets; Destroying public assets; Handling public assets in case of loss or destruction; Establishing ownership rights of the entire people; Handling assets with established ownership rights of the entire people.
