Chairman of the Provincial People's Committee: There are still problems causing difficulties for investors

108 files are overdue for processing
According to the report, regarding the results of handling administrative procedures on investment at the Southeast Economic Zone Management Board: Administrative procedures carried out at the one-stop department under the jurisdiction of the Southeast Economic Zone Management Board were basically handled on time or ahead of schedule, with no late files. However, files related to the implementation of investment policy approval procedures under the jurisdiction of the Provincial People's Committee were all delayed due to the need to seek opinions from relevant departments, branches and localities.
The total number of received records is 312, of which 97% of records were resolved and returned on time and before the deadline, and 3% were late.

Regarding the implementation of land allocation and land lease procedures, currently, in the Southeast Economic Zone, there are 50 projects approved by the Provincial People's Committee for investment policy, and the Southeast Economic Zone has issued investment registration certificates, but the process of implementing compensation for site clearance, land recovery, land allocation and land lease cannot be implemented due to the overlap between the provisions of the 2013 Land Law and the 2014 Investment Law.
The time for land lease implementation according to regulations for a project is 34 days, but in reality, it takes about 3 months to sign a land lease contract.

In the first 11 months of the year, the one-stop-shop has guided and received 1,418 dossiers to be transferred to the presiding agencies for processing. As of November 15, 2018, there are still 106 dossiers in the field of investment policy decisions and investment registration certificate adjustments that have exceeded the processing deadline without results, of which 80 newly-arrived dossiers in 2018 are backlogged.

There is still a phenomenon of "swinging" causing trouble for businesses.
At the meeting, delegates analyzed the reasons for the delay or overdue of files. Most of the overdue or delayed files are files and procedures that are interconnected and involve the responsibilities of many departments, branches, localities and units according to regulations, so the processing time is often longer than prescribed.
In fact, the departments, branches and localities have responded much later than the prescribed time, and even after the prescribed time has expired, they still have not received a response, leading to the Southeast Economic Zone Management Board not having a basis to advise the Provincial People's Committee to approve the investment policy...

Speaking at the meeting, Chairman of the Provincial People's Committee Thai Thanh Quy suggested: There are still phenomena of reverse application, harassment, "swinging" to make things difficult for investors. To improve the environment, create favorable conditions for investors and businesses, civil servants must change their mindset in serving.
The Chairman of the Provincial People's Committee requested departments, branches and localities to strengthen administrative reforms; continue to promote the application of information technology. During the time of developing the Public Administration Center project, the Investment Promotion Center and departments and branches should advise on the development of investment efficiency standards to select investment options... Sharing about the content of the visit and learning from the experience of other provinces in handling investment procedures through the reception and return of results department according to the one-stop mechanism in the investment field, the Chairman suggested that it is necessary to send people who are well-versed and effective, creating a spread in learning and drawing on experiences.
According to the synthesis, there are 106 dossiers that departments, branches, People's Committees of districts, cities and towns have not yet responded in writing to opinions on dossiers in the fields of deciding on investment policies, granting/adjusting investment registration certificates, including:
Provincial departments and branches: Department of Construction (23 records), Department of Planning and Investment (6), Department of Natural Resources and Environment (4).
Localities: People's Committees of Vinh city (15), Quynh Luu (10), Hung Nguyen (9), Nam Dan (8), Hoang Mai (6), Anh Son (5), Thai Hoa (5), Nghi Loc (4), Yen Thanh (4), Quy Hop (2), Nghia Dan (2), Dien Chau (1), Do Luong (1), Thanh Chuong (1).
