(Baonghean.vn) - The work of handling complaints and denunciations (KN, TC) of citizens has been paid attention to by all levels and functional agencies in the province, however, the number of incorrect complaints and denunciations is still high, causing negative impacts and many consequences for society. Nghe An Newspaper had an interview with Mr. Le Anh Son - Deputy Chief Inspector of the province about this issue.

- Reporter: Could you please tell us about the implementation of the Law on Complaints and the Law on Denunciation in the province recently?
Mr. Le Anh Son:
In recent times, the Law on Complaints, the Law on Denunciations 2011, the Law on Citizen Reception 2014 and the guiding documents for their implementation have been paid attention to by all levels and sectors in the province, leading, directing and organizing effective implementation. Specifically, they have actively organized propaganda and guidance on the implementation of the law on citizen reception, complaint and denunciation settlement. Heads of all levels, sectors, heads of units and localities have paid attention and focused on the work of citizen reception, complaint and denunciation settlement.

In particular, on June 14, 2018, the Chairman of the Provincial People's Committee issued Decision No. 27/2018/QD-UBND on promulgating the Regulations on assessment and classification of Inspection work; public reception; settlement of complaints; denunciations; recommendations, reflections, land disputes and anti-corruption in Nghe An province. Therefore, many complicated and crowded complaints and denunciations have been paid attention to by the entire political system to resolve them, contributing to the stability of security, politics, social order and safety, serving the socio-economic development in the province.

However, the situation of complaints and denunciations by citizens in Nghe An province still has many potential complications, especially in the fields of land, compensation for site clearance when the state acquires land... It is worth noting that the situation of citizens making false complaints and denunciations still accounts for a high rate, not only causing instability in security, politics, social order and safety; hindering socio-economic development but also wasting time, effort and costs for state agencies, as well as for the complainants and denouncers themselves.

In 2018 alone, regarding complaint settlement: the whole province resolved 213/223 cases, reaching a rate of 95.5%. Of which, the number of correct complaints was 24/213 cases, accounting for 11.3%. The number of correct and incorrect complaints: 56/213 cases, accounting for 26.3%. The number of incorrect complaints: 133/213 cases, accounting for 62.4%. Regarding denunciation settlement, the whole province resolved 132/137 cases in the year, reaching a rate of 96.4%. Of which, the number of correct denunciations: 16/132 cases, accounting for 12.1%; The number of correct and incorrect complaints: 35/132 cases, accounting for 26.5%. Number of false accusations: 81/132 cases, accounting for 61.4%.

- Reporter: So, what are the main reasons leading to the current high rate of false complaints and denunciations, sir?
- Mr. Le Anh Son:
There are many reasons for false complaints and accusations, but objectively, it is mainly due to the fact that land laws still have many shortcomings, such as according to the provisions of the 2003 Land Law, which stipulates compensation and support for agricultural land interspersed in residential areas, which is supported at a maximum of 35% of the price of adjacent residential land in residential areas, but the 2013 Land Law does not have this provision.

Therefore, when the state reclaims land from people at two different stages on the same land, there will be two different compensation levels, leading to persistent complaints from people. In addition, there are cases where when implementing public investment projects, compensation is based on state unit prices, while investment in production and business is also based on state unit prices, but investors can negotiate separately with people whose land is reclaimed, leading to people having comparisons and questions.

Second, although false denunciations affect the reputation of organizations and individuals, waste time, effort and costs for state agencies, as well as for the complainants and denouncers themselves, and cause many consequences for society. However, this behavior is often ignored, or handled only at the perspective of giving advice and drawing lessons, so it has no deterrent effect. The competent agencies that handle complaints and denunciations are also afraid to handle them, afraid of conflicts, and are considerate... so the complainants and denouncers are not fully aware of their violations.

In addition, there is currently no clear, specific mechanism or separate decree on handling administrative violations in the field of complaints and denunciations. The Law on Complaints does not stipulate that complainants must pay fees when filing complaints with state administrative agencies. If the complaint is incorrect, the complainant will not suffer any loss or impact. The Law on Denunciations also does not have clear sanctions for those who make false accusations. These are limitations and shortcomings in the practical implementation of the law on complaints and denunciations.

Subjectively, the cause of false complaints and denunciations is that people's legal awareness is limited, so there are demands and demands outside the provisions of the law, leading to prolonged cases. However, there are also people who intentionally make false complaints and denunciations, prolonged complaints and denunciations stemming from personal motives and intentions, or with the idea of ​​winning or losing. In addition, the work of propagating, disseminating and educating the law in general and the law on complaints and denunciations to all people is still limited. Sometimes, in some places, the state propagates and disseminates but people still do not care; only when their rights are affected do they begin to learn, but because they do not have a firm grasp of the provisions of the law, it leads to misunderstanding and incorrect application in practice.

- Reporter: To limit false denunciations, what specific solutions should we focus on, comrade?
- Mr. Le Anh Son:
In the coming time, the situation of complaints and denunciations in general will continue to develop complicatedly and will mainly focus on the land sector, in localities and areas where a lot of land is reclaimed from the people to implement socio-economic development projects. Mass and complicated complaints will arise in places where land acquisition and site clearance are not done well, and where due attention is not paid to the work of mobilizing, persuading and resolving complaints and denunciations of citizens.

Therefore, it is necessary to focus on innovating the method of disseminating the Law on Public Propagation in general, and the Law on Citizen Reception, Complaints and Denunciations in particular, contributing to raising awareness among officials and people about complaints, denunciations and the settlement of complaints and denunciations. Sectors and localities must create favorable conditions for citizens to exercise their rights to complain, denounce, make recommendations and reflect in accordance with the provisions of law; explain and guide according to regulations cases where citizens intentionally make complaints and denunciations for a long time without grounds to limit complaints and denunciations beyond the level and reduce the situation of false complaints and denunciations.

Enhance the responsibility of leaders of local Party committees, authorities and units in receiving citizens, resolving complaints and denunciations; increase the quantity and quality of cadres working in receiving citizens, resolving complaints and denunciations at all levels and sectors; strengthen dialogue, promptly and thoroughly resolve new cases arising from the grassroots, avoid causing resentment and dissatisfaction among the people, and avoid cases being left pending and prolonged.

Strengthen coordination between the Provincial Citizen Reception Committee, the Provincial Inspectorate and central and local agencies in receiving citizens, handling petitions, resolving complaints and denunciations; especially promptly and effectively handling mass complaints and denunciations. Pay attention to the remuneration regime, arrange a sufficient number of competent and qualified staff to receive citizens, resolve complaints and denunciations from the grassroots level.

In addition, it is necessary to combine the inspection of responsibility with the inspection of public service, improve the skills and expertise in classifying and handling petitions of the officers receiving citizens when receiving petitions and denunciations. Any content that is true must be seriously resolved; for untrue content, after having an official conclusion, it must be transferred to individuals and competent agencies for handling according to the provisions of law to increase deterrence and ensure the supremacy of the law. In cases of intentional false denunciations with signs of crime, it is recommended to transfer to the competent agencies for investigation and criminal prosecution.
On the other hand, from the practice of enforcing the law on complaints and denunciations, it is necessary to recommend that the Government urgently issue a Decree on administrative sanctions to handle acts of false denunciations. Only then can we limit the situation of false, prolonged, and over-level complaints and denunciations as in the past./.
