Heartbreaking case of uncle killing nephew at death anniversary
(Baonghean.vn) - At the death anniversary, a conflict arose between Dinh and his nephew Pham Van Dong. In a moment of losing control, Dinh took a stick and beat his nephew to death.
The Provincial People's Court has just opened a first-instance criminal trial of defendant Nguyen Ba Dinh (born 1962), residing in Vinh Tan ward, Vinh city, for the crime of "Murder due to exceeding the limits of legitimate self-defense".
Those who attended the trial, from the defendant, the legal representative of the victim, witnesses… were family members. The victim was Pham Van Dong (born 1979), who called Dinh his uncle.

The investigation determined that on July 22, 2017, Dinh's relatives came to attend his brother-in-law's death anniversary. While drinking, Dong cursed at everyone and made a scene, so Dinh chased him away. The two uncle and nephew got into a fight. After being stopped by everyone, Dinh went home and closed the gate.
A moment later, Pham Van Dong took a knife and returned to threaten everyone, threatening to kill Dinh's entire family. Seeing Dong pushing the gate into the house with a knife, Nguyen Ba Dinh took a piece of wood and hit his nephew many times on the body and head. Only when he saw his nephew collapse did Dinh stop. Although the victim was taken to the emergency room by everyone, he later died due to severe injuries.
The forensic examination report showed that the cause of Mr. Dong’s death was due to a skull fracture. After the incident, Nguyen Ba Dinh compensated the victim 250 million VND.
Before this trial, the Provincial People's Court had brought the case to trial twice. In the previous trial, the legal representative of the victim argued that the indictment of the Nghe An Provincial People's Procuracy did not accurately represent the events as some other witnesses did.
These witnesses are not present in court, so the representative requested the panel of judges to summon or, if necessary, escort the witnesses to confront and clarify the details of the case. After summoning a number of additional witnesses, realizing that the case still had many unclear issues, the panel of judges adjourned the trial and returned the file to the Nghe An Provincial People's Procuracy for further investigation.
At the trial held on January 23, 2019, a number of witnesses were again missing. After deliberation, the panel of judges determined that in this case, after returning the file, this was the first time the trial had been convened. Due to the lack of witnesses, to ensure objectivity, the court decided to postpone. In the next trial, other important witnesses in the case will have to be summoned and ordered to be escorted.
