Driver Phien prosecuted for forgetting student at Gateway School

The investigation agency continues to prosecute driver Doan Quy Phien, the driver of the shuttle bus in the case of a first-grade student at Gateway School who was left in the bus and died.

On the afternoon of September 3, the Investigation Agency of Cau Giay District Police issued a decision to prosecute Mr. Doan Quy Phien (contract employee of Ngan Ha Transport Company Limited) - the driver who picked up and dropped off students at Gateway School, in the case of a first grader who died on the school bus.

Mr. Phien was prosecuted for "involuntary manslaughter" under Article 128 of the Penal Code and was placed on bail and prohibited from leaving his place of residence. The same-level People's Procuracy approved the above prosecution decision.

The investigation agency determined that in the case of LHL, a first grade student at Gateway School who was forgotten on the school bus and died, the driver Doan Quy Phien was responsible for not directly checking the bus before closing the door and leaving it to the person who picked him up, Ms. Quy. As a result, L. was forgotten on the Ford Transit with license plate 29B-069.56 for 9 hours on August 6.

Previously, the investigation agency prosecuted and temporarily detained Ms. Nguyen Bich Quy (54 years old, in Cau Giay district, Hanoi), who picked up and dropped off students at Gateway School, to investigate the crime of involuntary manslaughter.

Ms. Quy was accused of "unintentionally not checking everything in the car before closing the door and leaving", leading to baby LHL being left in the Ford Transit with license plate 29B-069.56 for 9 hours on August 6.

According to the autopsy results, the baby died of heat shock and respiratory failure, with no pathological cause.

The People's Procuracy of Cau Giay District also said that in the death of baby L., the driver Doan Quy Phien (53 years old, contract employee of Ngan Ha Transport Company Limited) was responsible for not directly checking the vehicle before closing the door but leaving it to the person picking up and dropping off, Ms. Quy.

These two people were determined by the Procuracy to have been "unintentionally confident and negligent".

According to the People's Procuracy of Cau Giay District, this is the initial investigation result and in the process of clarifying the case, Gateway School's responsibility will be considered.

On the afternoon of August 30, the Investigation Police Agency of Cau Giay District Police also conducted a crime scene reenactment at Gateway Primary School to investigate the cause of death of the 6-year-old child.
