The Secretariat concludes on handling violations in the recruitment of cadres and civil servants
Standing member of the Secretariat Tran Quoc Vuong has just signed and issued Conclusion No. 71 on handling violations in the recruitment of cadres, civil servants and public employees.

This conclusion is made in accordance with the conclusion announcement No. 43 dated December 28, 2017 of the Politburo. Accordingly, the Secretariat requested to strengthen leadership, direction, inspection, supervision and prevention of negativity in personnel work in general and in the recruitment of cadres, civil servants and public employees in particular.
The Secretariat assessed that, over the past time, Party committees and organizations at all levels have thoroughly grasped and implemented the Secretariat's conclusions on the results of self-inspection and review of personnel work according to Conclusion Notice No. 43 of the Politburo; reviewed and handled cases that did not properly implement regulations on standards, conditions, processes and procedures in planning, rotation, transfer, promotion, appointment, reappointment and nomination for candidacy.
However, through review, inspection and examination, it is shown that there are still difficulties, inadequacies and disagreements in handling violations related to the recruitment of cadres, civil servants and public employees, including cases that have been appointed to leadership and management positions or are personnel expected to participate in the Party Committee for the 2020-2025 term.
Completely handle detected violations
To ensure consistency and unity in handling violations in the recruitment of cadres, civil servants and public employees, the Secretariat requires Party committees at all levels, Party organizations, and leaders of relevant agencies and units to perform a number of tasks.
Firstly, strengthen leadership, direction, inspection, supervision and prevention of negativity in personnel work in general and in the recruitment of cadres, civil servants and public employees in particular. Timely detect, rectify and handle according to authority the party organizations, agencies and affiliated units that have not properly implemented the regulations on recruitment of cadres, civil servants and public employees.
Second, focus on thoroughly handling cases of violations that have been discovered. Specifically, revoke recruitment decisions for cases where there are conclusions of violations in the recruitment of cadres, civil servants and public employees by competent agencies.
At the same time, review, clarify responsibilities and strictly handle according to Party regulations and State laws for Party committees, Party organizations, agencies, units, collective leaders and related individuals.
The regulations will not be revoked for cases that were recruited without ensuring standards, conditions, processes and procedures from December 28, 2017 or earlier but have fully completed the standards and conditions and have been commented and evaluated by the head of the agency, organization or unit using the cadres, civil servants and public employees as having fulfilled their assigned duties and tasks well, having good moral qualities and reputation, and during their working time not violating Party regulations, State laws, internal rules and regulations of the agency or organization.
In case the criteria and conditions are not fully completed, they must be completed by December 31, 2020 at the latest. If they are not completed by this deadline, the recruitment decision will be revoked.
In cases of recruitment of cadres, civil servants and public employees after December 28, 2017 that do not ensure standards, conditions, processes and procedures, the recruitment decision will be revoked.
Inspection and supervision of specialized personnel work
In cases where standards and conditions are met but recruitment procedures and processes are not followed correctly, there are two cases to be handled.
Firstly, if the head of the agency, organization, or unit employing the cadre, civil servant, or public employee comments and evaluates that the employee has fulfilled his/her assigned duties and responsibilities well, has good moral qualities and reputation, and during his/her working period has not violated Party regulations, State laws, or internal rules and regulations of the agency or organization, then consideration will be given.
In particular, for those who are required to take the exam but have not yet taken the exam, they must participate in the exam; if they are selected, the policies and regimes will be calculated from the previous recruitment date.
Second, if they do not fulfill their assigned duties and tasks well, have low moral qualities and prestige, or violate Party regulations, State laws, internal rules and regulations of agencies and organizations, the recruitment decision and related decisions on personnel work after recruitment will be revoked for that cadre, civil servant or public employee.
The Secretariat noted that the Government Party Committee directed the Ministry of Home Affairs to issue a document with specific instructions on handling violations in the recruitment of cadres, civil servants and public employees, to be completed this April.
The Secretariat assigned the Central Organizing Committee to preside over and coordinate with the Party Central Committee, the Government and relevant agencies to urge localities, agencies and units to promptly overcome shortcomings and limitations in personnel work.
At the same time, develop plans and organize specialized inspections, audits, and supervisions on personnel work; especially the handling of violations in personnel work of localities, agencies, and units; urge and monitor the implementation of this conclusion and periodically report to the Secretariat.
