1 year in prison for not wearing a mask, smashing police phone
When reminded not to wear a mask, the subject did not comply, had a defiant attitude, smashed the phone, and obstructed the functional forces of Bac Ninh province.
Yen Phong District People's Court has just opened the first instance trial of the case of "Resisting a person on official duty" against defendant Nguyen Van Quynh (born in 1986, residing in Thiem Xuyen village, Thuy Hoa commune, Yen Phong district).
According to the indictment of the district People's Procuracy, at around 1:00 p.m. on April 7, Quynh rode a motorbike from Thiem Xuyen village through the Covid-19 epidemic prevention and control checkpoint set up at the village football field area (checkpoint number 2) to Ap Don village, Yen Trung commune to play with friends.
Although Quynh had a mask in his pocket at that time, he did not wear it, so the force on duty at the checkpoint reminded him to wear a mask according to regulations and let him through the checkpoint.
After that, Quynh went to the rented room of Nguyen Van Phu (born in 1992) in the same village to play and eat. After eating, Phu drove Quynh back to Thiem Xuyen village via another road.
At around 3:50 p.m. the same day, Quynh took Mr. Phu by motorbike through checkpoint number 2 to his rented house in Ap Don village. Because Quynh and Mr. Phu were both not wearing masks, the working group required them to wear masks before they could pass the checkpoint. When reminded, Quynh did not comply and cursed, then turned around and took another route to Ap Don village.
At around 4:45 p.m. the same day, Quynh drove alone from Ap Don village through checkpoint No. 2 to return to Thiem Xuyen village. When passing through the checkpoint, because Quynh did not wear a mask as required, the task force reminded him and asked him to wear a mask. Quynh continued to disobey and said the reason was that his mask was torn.

At this time, Ms. Nguyen Thi Thu (village health officer, member of the inspection team) gave Quynh a medical mask and told him to put it on and go home, but Quynh did not take it and continued to swear.
When some other members of the control team No. 2 explained the rules, Quynh cursed and insulted them. Deputy Chief of Thuy Hoa Commune Police Nguyen Van Duc (Deputy Head of the Control Team, on duty at the checkpoint) used his phone to record Quynh's act of resistance. Quynh cursed Duc and threw the phone on the ground, breaking the screen beyond repair.
In the asset valuation conclusion of the Asset Valuation Council in criminal proceedings of Yen Phong district, it was concluded: “The value of the damaged mobile phone screen is 4,853,000 VND”. On April 12, Mr. Nguyen Hong Quan (Quynh’s brother) compensated Mr. Nguyen Van Duc with 5.5 million VND.
Defendant Nguyen Van Quynh has a bad personal history. On February 5, 2018, he was administratively fined by Yen Phong District Police for fighting. In addition, Quynh also has a criminal record, being administratively fined by the District Police for intentionally damaging other people's property, with a fine of 3.5 million VND, and has not yet paid the fine.
At the trial, the defendant admitted his crime. Considering that his actions were dangerous to society, negatively affecting security and order, especially at a time when the whole country was strictly implementing epidemic prevention and control measures, the Trial Panel sentenced Nguyen Van Quynh to the crime of "Resisting a person on official duty" as prescribed in Clause 1, Article 330 of the Penal Code, with a sentence of 12 months in prison, starting from April 7.
The trial was broadcast live on the district's radio system for all people to follow, thereby educating individuals and preventing the general public, ensuring the strictness of the law, contributing to promoting the prevention and control of the Covid-19 epidemic.
