Nghe An Provincial People's Court has just opened a criminal appeal trial of Sam Minh Hop (born 1996), residing in Chau Cuong commune, Quy Hop district, for the crime of "Intentionally causing injury".
According to the indictment, at about 10:00 p.m. on February 2, 2019, Nguyen The L. (born 2001), residing in Nghia Xuan commune, Quy Hop district, drove a motorbike carrying two female friends home in Chau Cuong commune.
When arriving at the gate of Nhoi village, Chau Cuong commune, I saw a group of young men standing around, including: Dao Van Tai (born 1998), Nguyen Van Dat (born 1998), Quan Vi Than (born 2004), Ngan Van Hung (born 2002), Sam Minh Hop, Quang Canh Tai (born 2004), all residing in Chau Cuong commune.
At this time, Tai said to the group: "Hey, when that guy comes out, stop him and scare him for fun." Everyone agreed.
About 10 minutes later, when Mr. L. returned, Sam Minh Hop stopped the car and asked, "Where are you from?" As soon as L. finished answering, Hop repeatedly punched him in the face. Tai took out his phone and recorded a video, saying, "Go ahead and hit him. I'll stand outside and record a video for fun."

When L. fell into the ditch, the subjects continued to kick the young man in the head. At this time, Tai stopped filming and said, "Let him go," so the subjects stopped beating him. After that, Hop told L. to kneel down and apologize. Being forced, L. knelt down on the street to apologize and then took his motorbike and left.
At that time, two young men from the village passed by and asked what was going on. Dat replied, "This guy is rude, bro." One of them said, "Keep hitting him" and then drove away on his motorbike. Nguyen The L. had only gone about 1-2 meters when Dat and Tai used a wooden stick to repeatedly hit L.'s head and body until the stick broke and then threw it away.
Mr. L. was helped up by Hop and Tai on his motorbike, then he rode it home to sleep. On the morning of February 3, 2019, Mr. L. fell into a coma, so his family took him to the Nghe An Provincial General Hospital for emergency treatment from February 3 to April 5 before he was discharged. After that, Mr. L. filed a request to assess the disability rate and initiate a criminal case. Mr. Nguyen The L. was diagnosed with a 43% disability rate and traumatic brain injury.
The defendants Dao Van Tai, Nguyen Van Dat, Quan Vi Than, Ngan Van Hung, and Quang Canh Tai were brought to trial for “Intentionally causing injury”. Sam Minh Hop, after causing the incident, fled and was wanted by the police.
Hop then turned himself in and was brought to trial. At the first instance trial, Hop was sentenced to 5 years and 6 months in prison for Intentional Infliction of Injury. The defendant then filed an appeal, asking for a reduced sentence.
At the appeal court, the defendant turned down to apologize to the victim and expressed remorse, asking for a reduced sentence.
Considering the case as a whole, the appellate court partially accepted the appeal of defendant Sam Minh Hop, amending the first instance sentence from 5 years and 6 months in prison to 5 years in prison for the crime of Intentional Infliction of Injury.
