New regulations on job positions in public service units
The Government has just issued Decree 106/2020/ND-CP on job positions and number of employees in public service units.

The government requires the identificationJob position and number of employeesmust be consistent with the functions, tasks, powers and organizational structure of the public service unit; ensure scientific, objective, public, transparent, effective and improve the quality of the staff and employees in the public service unit. Ensure that a worker is assigned enough work to perform according to the prescribed working time. Job positions that do not have enough work to perform according to the prescribed working time of a worker must be arranged to hold concurrent positions.
At the same time, it is necessary to ensure a reasonable structure, in which the number of people working in specialized job titles and shared professional job titles accounts for at least 65% of the total number of employees of the public service unit.
Basis for determining job position
Decree 106/2020/ND-CPSpecify 2 bases for determining job positions including: 1- Functions, tasks, powers, organizational structure of public service units; 2- Level of complexity, nature, characteristics, scale of operations; scope, service objects; professional and technical management process according to regulations of specialized laws.
The Decree also clearly states 3 bases for determining the number of employees, including: 1- Job position and actual workload at each job position of the public service unit; 2- Level of modernization of offices, equipment, working means and application of information technology; 3- Current status of management and use of the number of employees assigned to the unit.
Also according to the Decree, the basis for determining the structure of civil servants according to professional titles includes: 1- List of job positions; 2- Level of complexity of the job position; 3- Standards and professional titles of civil servants corresponding to the job position.
No later than June 30, 2021, a document guiding job positions must be issued.
The Decree clearly states: No later than June 30, 2021, the Minister of the Ministry managing the sector or field must issue a document guiding the positions of management leaders and professional titles, the structure of civil servants according to professional titles and the number of employees for public service units in the sector or field assigned to him/her; the Minister of Home Affairs shall issue a document guiding the positions of professional titles used in common use and support and service of public service units.
No later than 03 months from the date the Minister of the sector or field management and the Minister of Home Affairs issue the guiding document, ministries, sectors and localities must approve the job positions and staff structure according to professional titles of public service units under their management.
Decree 106/2020/ND-CP takes effect from November 15, 2020 and replaces Decree No. 41/2012/ND-CP dated May 8, 2012 regulating job positions in public service units.
