Improve document appraisal activities to avoid overlapping regulations

(Baonghean.vn) - On the morning of October 16, the Ministry of Justice held a national online conference to implement the Law on amending and supplementing a number of articles of the Law on Promulgation of Legal Documents.

Comrade Hoang Quoc Hao - Director of the Department of Justice chaired the Nghe An bridge. Attending the conference were representatives of leaders of units, localities; and relevant departments and branches.

The conference deployed new contents of the Law amending and supplementing a number of articles of the Law on Promulgation of Legal Documents promulgated by the National Assembly on June 18, 2015.

However, the implementation process has revealed a number of difficulties and problems because the law has not clearly defined the responsibilities of each agency and organization and the coordination between agencies and organizations in the process of receiving and revising draft laws, ordinances and resolutions.

Based on the above request, the 14th National Assembly passed the Law amending and supplementing a number of articles of the Law on Promulgation of Legal Norms (effective from January 1, 2021). The Law amends and supplements 68 articles, including 54 articles on content and 14 articles on technique of the 2015 Law.

The National Assembly passed the Law amending and supplementing the Law on Promulgation of Legal Norms.

In particular, focusing on basic contents such as: More specific regulations on the mechanism to ensure the leadership of the Party; supplementing and clarifying regulations on social criticism of the Vietnam Fatherland Front in the process of building and promulgating legal documents.

The 2020 Law has added a number of document forms including: Joint Resolution between the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front; Joint Circular between the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, the State Auditor General, Ministers, and Heads of ministerial-level agencies.

The authority to promulgate legal documents at district and commune levels is amended in the direction of: Allowing the People's Council at district level to promulgate Resolutions, the People's Committee at district level to promulgate legal decisions to implement decentralization to local authorities and lower-level state agencies; adding the case of "Resolution assigned by the National Assembly", the People's Council and People's Committee at district and commune levels are also allowed to promulgate legal documents.

In addition, the 2020 Law also has many other notable new points such as: Narrowing the scope of legal documents that require proposals for development according to policy procedures and specifying the order and procedures for making proposals for development and drafting legal documents; enhancing the responsibility and effectiveness of coordination between agencies in the process of examining, receiving, and revising draft laws, ordinances, and draft resolutions; regulations on development and promulgation of legal documents according to shortened procedures; regulations on administrative procedures in legal documents...

At the conference, the participants raised a number of issues regarding the amended and supplemented Law. The delegates' issues were received and answered by representatives of the Department of General Issues on Lawmaking, Ministry of Justice.

At the conference, comrade Phan Chi Hieu - Deputy Minister of Justice summarized a number of outstanding issues such as: Establishing a coordination mechanism in law enforcement agencies, reducing administrative procedures; Implementing measures to improve the quality of promulgating legal documents, collecting opinions from people or subjects affected by legal documents; improving document appraisal activities to avoid overlapping regulations; building a legal team in departments and branches./.
