Come to 'save' brother, brother goes to jail
(Baonghean.vn) - Due to a conflict over exchanging floor tiles, Hung was beaten by a group of brothers in a neighboring commune. Being beaten, Hung called his brother for help. As a result, both brothers were in trouble with the law, with the brother being charged with "Murder".
On April 7, Nghe An Provincial People's Court opened a first-instance criminal trial of defendant Nguyen Huy Duoc (28 years old), residing in Son Hai commune, Quynh Luu district, for the crime of "Murder".
6 defendants Nguyen Huy Cuong (24 years old, residing in Son Hai commune), To Huy Hai (60 years old), To Van Hien (48 years old), To Van Hoai (52 years old), To Van Duc (56 years old), Nguyen Duc Thang (30 years old), all residing in Quynh Thuan commune, Quynh Luu district were prosecuted for the crime of“Disturbing public order”.
Among the defendants, Duoc and Cuong are brothers. The defendants Hai, Hien, and Hoai are also brothers.
The records show that on April 19, 2020, Cuong's family bought floor tiles from a building materials store owned by To Huy Hai. The next day, Cuong discovered that some tiles were broken, so he brought the tiles to the store and asked for a replacement, but was refused. The two sides had a conflict and fought.

After being beaten by his two brothers Hai and Hien, Cuong called his brother for help, "Brother, I went down to change bricks and was beaten by them down here."
Receiving his brother's call for help, Duoc rushed in and used his hands and feet to punch and kick To Van Hien. After that, the two brothers Duoc and Cuong were chased by Hai, Duc, Hien, and Thang using iron bars, pipes, and wooden sticks.
Angry, Duoc used a hoe to hit Hien on the head, causing a fractured skull and brain damage. The current damage caused by the injury is 61%.
At the witness stand, the defendants admitted to the crimes as charged in the indictment. Defendant Duoc stated that because he saw his younger brother being beaten by Hai's group, he could not control his actions.
Appearing in court as both defendant and victim, To Van Hien stated that due to a traumatic brain injury, his health is currently poor. Defendant Hien asked for a reduced sentence for Duoc.
The panel of judges determined that the defendant Duoc had committed a dangerous act, and that the victim's death was beyond the defendant's subjective intention, so they sentenced Nguyen Huy Duoc to 5 years in prison for the crime of "Murder".
For the defendants convicted of "Disturbing public order", the court sentenced Cuong, Hai, and Duc to 24 months in prison with a suspended sentence; and defendants Hien, Hoai, and Thang to 30 months of non-custodial reform.
