(Baonghean.vn) - On the afternoon of October 21, continuing the program of the 2nd session of the 15th National Assembly, the National Assembly discussed in groups about 2 draft laws: the Law on Mobile Police and the Law on amending and supplementing a number of articles of the Law on Intellectual Property.

Comrade Thai Thanh Quy - Member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the Provincial National Assembly Delegation, Chairman of the Provincial People's Council chaired the discussion session at the Delegation of the National Assembly Delegation of Nghe An province.

On behalf of the Government, General To Lam - Minister of Public Security presented the Report on the draft Law on Mobile Police. The draft law consists of 5 chapters and 31 articles, stipulating the position, functions, tasks, powers, organization and operation of the Mobile Police; conditions for ensuring and regimes and policies for the Mobile Police; responsibilities of relevant agencies, organizations and individuals.

The Draft Law shows that the State builds a revolutionary, disciplined, elite, and modern Mobile Police force; prioritizes resources for developing the Mobile Police force. Vietnamese agencies, organizations, and citizens have the responsibility to participate in building a clean and strong Mobile Police force.

Presenting the Report on the draft Law amending and supplementing a number of articles of the Law on Intellectual Property, Minister of Science and Technology Huynh Thanh Dat said that the Law on Intellectual Property was issued in 2005, after 2 amendments and supplements, but up to now there are still shortcomings and problems.

The Draft Law amending and supplementing a number of articles of the Law on Intellectual Property proposes to amend and supplement 92 articles of the Law on Intellectual Property. In particular, it mainly focuses on amending the following contents: subjects of intellectual property rights, State policies on intellectual property, types of works protected by copyright, copyright protection period, etc.

Discussing the draft Law on Mobile Police, full-time National Assembly delegate of Nghe An Delegation Tran Nhat Minh expressed his agreement with the Government's submission on the necessity of promulgating the Law on Mobile Police. However, the draft law does not stipulate the function of fighting and preventing crime and law violations of the Mobile Police, which is not fully compliant with the Law on People's Public Security.

Analyzing this content in depth, delegate Minh said that in Article 9 of the draft law, regarding the duties of the Mobile Police, the task of suppressing and preventing crime is stated. In reality, the crime prevention function of the Mobile Police is very clear. In recent times, the Mobile Police force has organized forces to participate in fighting major criminal, economic, drug, high-tech crime cases, etc.

Delegate Tran Nhat Minh also said that during the implementation process, many activities of the Mobile Police force could affect human rights and basic rights of citizens. The Mobile Police force is the core force to implement armed measures to protect national security and ensure social order and safety.

Therefore, in order to create a complete and solid legal corridor for the activities of the Mobile Police while still meeting the requirements of ensuring human rights and basic rights of citizens, it is necessary to make the content of ensuring human rights and basic rights of citizens the principles of operation of the Mobile Police.

Regarding the draft Law on amending and supplementing a number of articles of the Law on Intellectual Property, delegate Tran Nhat Minh said that regarding the right to register inventions, industrial designs, and layout designs of scientific and technological tasks using the State budget, it is necessary to amend and supplement in the direction that the organization in charge of the research has the right to register. This plan will promote the commercialization of intellectual property rights, instead of being under the State's registration right as currently.

Regarding administrative sanctions for intellectual property infringements, delegate Minh said that it is necessary to maintain the current regulations. At the same time, it is necessary to distinguish between the jurisdiction of the Court in resolving disputes and the jurisdiction of state management agencies in resolving administrative violations to ensure compliance with other regulations.

Delegate Thai Thi An Chung - Deputy Head of the Provincial Delegation of National Assembly Deputies, said that comprehensive amendments are needed because the Intellectual Property Law was issued in 2005 and has been amended twice, with 92 Articles being amended this time. In addition, the scope of this amendment is so large that there should be an Intellectual Property Law (amended) for easier monitoring and application.

Delegate Thai Thi An Chung also agreed that the research host organization should have the right to register patents for technological designs and layout designs as a result of scientific and technological tasks using the state budget. Because this option will promote scientific research, the research host organization, when granted the right, will use it more effectively and promote its role.

Regarding the content of administrative sanctions for acts of intellectual property infringement, delegate Chung said that it is necessary to clearly distinguish the level of the violation, depending on the case to handle administratively or criminally. As for the issue of intellectual property disputes, from a civil perspective, it can be handled in many forms such as lawsuits, arbitration mechanisms, and agreements between the parties. Therefore, it is necessary to re-examine both options proposed by the Government./.
