(Baonghean.vn) - A household in Thinh Son commune (Do Luong) has been brazenly encroaching on land for a long time, even building a fence around a residential road, causing public outrage. However, the incident has dragged on for many years without being resolved.

Blatantly swallowing the whole residential road

Recently, Nghe An Newspaper reporters have continuously received complaints from residents of Hamlet 6, Thinh Son Commune (Do Luong) about a household brazenly encroaching on public land for a long time. “Not only encroaching on public land, this family also occupies the entire road and drainage ditch. We are all very upset. We have been reporting and requesting solutions for many years now, but they have not been resolved completely,” said a resident who asked to remain anonymous.

The household that these people reported is the family of Mr. Nguyen Canh At (56 years old, living in Hamlet 6, Thinh Son Commune). According to the reporter's investigation, in 1998, Mr. At and his wife were assigned land by the People's Committee of Do Luong District with land use fees to build a house (according to Decision No. 41 QD/UB dated August 8, 1998 of the People's Committee of Do Luong District) with an area of ​​408 m2(of which, 200 m2residential land, 208 m2Garden land). The land is located next to Trang Minh inter-commune road, with a road frontage of 16 meters.

In addition, next to Mr. At's land, there is also a residential road and a drainage ditch running straight from the hill down to the Khuon River. This is the road that people in Hamlet 6 often use to go to the fields to produce, herd buffaloes, cows... However, for more than 10 years now, Mr. At's family has continuously encroached on public land, then built a fence around the road and drainage ditch and encroached on the commune's football field, causing people to be upset. Currently, Mr. At's land is more than twice as large as when it was allocated, up to nearly 1,000m2.2.

Mr. Nguyen Canh Dong - the head of hamlet 6, who lives opposite Mr. At's house, said that even though they are cousins, he could not defend Mr. At's encroachment. "I have been the head of hamlet for nearly 20 years, so I know very well about Mr. At's encroachment," Mr. Dong said. According to the head of hamlet, Mr. At initially bought a chainsaw and placed it on the residential road to work. At that time, Mr. Dong also came to remind him, but Mr. At still "turned a deaf ear". By 2015, Mr. At's family had occupied the road leading to their land by building a dike.

According to the reporter's investigation, the area of ​​land encroached by Mr. At is more than 548 m2.2. Of which, the land adjacent to Trang Minh street is nearly 10 meters long. Meanwhile, the market price of land in this area is currently around 100 million VND/meter. With about 10 meters of encroachment, the price is around 1 billion VND. “However, the problem is not money. No matter how many billions Mr. At spends to buy it back, it will not be possible. Because it is a residential road and a drainage ditch. We want the violation to be handled, and the road and drainage ditch must be returned to the people,” said a neighbor of Mr. At.

Need to deal with it thoroughly

Speaking with Nghe An Newspaper reporter, Mr. Vuong Ngoc Chien - Chairman of Thinh Son Commune People's Committee admitted that the reflections and frustrations of the people of Hamlet 6 regarding Mr. At's land encroachment were correct. Mr. Chien affirmed that Mr. At's family's violations had been clearly concluded. The process of considering and resolving the violations of Mr. Nguyen Canh At's household had been worked on many times by the People's Committee of Thinh Son Commune and the People's Committee of Do Luong District, taking a lot of time, but this household still deliberately refused to voluntarily dismantle the illegal construction on the encroached land area.

Specifically, since May 2018, after receiving feedback from the people, Do Luong District Party Committee announced the results of the survey of a petition from a number of party members and citizens of Thinh Son commune accusing Mr. Nguyen Canh At of encroaching on state-managed land. On September 7, 2018, Thinh Son Commune People's Committee issued Decision No. 139/QD-UBND on the establishment of a team to inspect the land use origin of Mr. Nguyen Canh At's household. The inspection process discovered violations of land encroachment and illegal construction of Mr. Nguyen Canh At's household. Thinh Son Commune People's Committee then worked with the citizen, through the work, Mr. At admitted to the act of encroaching on land and illegally constructing construction. However, during the settlement process, when Thinh Son Commune People's Committee requested Mr. At's household to voluntarily dismantle the construction and return the encroached land, this household did not comply.

On October 9, 2019, the People's Committee of Do Luong district worked directly with Mr. At. During the working process, the participants analyzed, propagated, and mobilized Mr. At to strictly comply with the provisions of the law on land and return the land area that his family had encroached. At the end of the dialogue, the People's Committee of the district issued a notice, assigning Mr. At to voluntarily dismantle illegal constructions on the land area managed by the State. If the family does not voluntarily comply, the People's Committee of Do Luong district will organize the forced demolition of illegal constructions according to the provisions of law.

However, Mr. Nguyen Canh At's household still did not voluntarily dismantle the illegal construction on the land area managed by the State. The District People's Committee and the Thinh Son Commune People's Committee later worked with him many times, but Mr. At did not cooperate with the authorities to resolve the violation. He even obstructed and threatened the authorities when they came to measure.

According to the reporter's investigation, for just one case of encroachment on public land, up to now, the People's Committee of Thinh Son commune and the People's Committee of Do Luong district have had to issue nearly 30 related documents in just the past 3 years. Most of them are notices requesting Mr. Nguyen Canh At's household to dismantle, relocate constructions, architectural objects and harvest trees and crops on the encroached land area; administrative violation records; Decision on applying remedial measures; Notice requesting Mr. Nguyen Canh At's household to voluntarily comply with remedial measures...

The Chairman of the People's Committee of Thinh Son commune admitted that the local government at that time had loosened land management, leading to land encroachment. Meanwhile, the handling of this violation was not done decisively and thoroughly, causing people to be upset. "I have only been here as Chairman of the People's Committee for more than a year, but I have received many petitions from people related to cases of encroachment on public land like this. Currently, we have decided to enforce and force the demolition of illegal constructions for some households. The case of Mr. At will be no exception," said Mr. Vuong Ngoc Chien./.
