Chairman of the Provincial People's Committee Nguyen Duc Trung received citizens at the regular session in March 2022
(Baonghean.vn) - On the morning of March 16, comrade Nguyen Duc Trung - Deputy Secretary of the Provincial Party Committee, Chairman of the People's Committee of Nghe An province chaired the regular citizen reception session in March 2022.
Chairman of the Provincial People's Committee Nguyen Duc Trung received Ms. Nguyen Thi Ha and Ms. Le Thi Ngoc Anh (representatives of 9 households residing in Hamlet 3, Nghia Thuan Commune, Thai Hoa Town). The households requested to be granted Land Use Right Certificates in the area of Traffic Palace 42A - Old Nghia Dan Traffic Department (now Hamlet 3, Nghia Thuan Commune, Thai Hoa Town) to soon stabilize their lives.

Regarding the origin and land use process of families, on May 21, 1977, the People's Committee of Nghe Tinh province issued Decision No. 1072/QD-UBND on land allocation to Road Management Section 5 Nghe Tinh to build and construct the Collective Housing and Workers' Area, Section 42A, District 13 Nghia Dan.
After being allocated land, 42A Traffic Palace used this land to build a collective housing area for workers and a workplace. By October 1992, households had written applications for land for housing and were issued land allocation notices by the Nghe Tinh Department of Transport.
In 1995, Road Management Section 5 handed over the land to the Waterway and Road Traffic Management Section for management and use. In 1996, the Waterway and Road Traffic Management Section was separated to establish the Road Traffic Management Section. In 1999, the name was changed to Nghe An Bridge and Road Construction Management Company.

In 2004, Nghe An Bridge and Road Construction Management Company equitized the enterprise and changed its name to Nghe An Bridge and Road Construction and Management Joint Stock Company. Therefore, this land is under the management of Nghe An Bridge and Road Construction and Management Joint Stock Company.
Currently, this land has 21 families using the land for housing, gardening, and perennial crop planting with an area of about 3.22 hectares. According to the land use planning of Thai Hoa town until 2020 approved by the Provincial People's Committee in Decision No. 443/QD-UBND dated June 26, 2020, the above land is planned for rural residential land.

The People's Committee of Thai Hoa town proposed that the Provincial People's Committee allow the People's Committee of the town to issue Land Use Right Certificates to households without issuing a land recovery decision according to Point a, Clause 1, Article 65, Land Law 2013 and without carrying out procedures for rearranging and handling houses and land according to the provisions of Point b, Clause 2, Article 1, Decree No. 67/ND-CP dated July 15, 2021 of the Government.
After listening to the citizen's presentation, the departments gave their opinions and concluded on how to resolve the case, Chairman of the Provincial People's Committee Nguyen Duc Trung emphasized that the citizen's request to be granted a land use right certificate is completely legitimate. Therefore, the agencies and Thai Hoa town must pay attention to consider and resolve it in accordance with the correct procedures and legal regulations.

Through the assessment documents, the origin and land use process of the households are clear; this land is not subject to land arrangement and handling according to Decree 167/2017/ND-CP and Decree No. 67/2021/ND-CP of the Government. Therefore, the households are eligible to be considered for granting Land Use Rights Certificates.
The Chairman of the Provincial People's Committee requested the People's Committee of Thai Hoa Town to consider and resolve the issuance of Land Use Right Certificates to households without issuing land recovery decisions; recognize people's land use rights according to actual use, ensuring people's rights.
Through this incident, the Chairman of the Provincial People's Committee noted that sectors and localities need to coordinate more closely and actively in the process of resolving similar cases. Thereby, quickly and completely resolving the case, creating the most favorable conditions for the people./.
