Sentence for the gunman who shot and killed 2 people in Vinh city

(Baonghean.vn) - Due to a conflict over debt, Cao Trong Phu used a gun to shoot and kill Mr. A. and a person accompanying him, causing a stir in public opinion.

On March 28, Nghe An Provincial People's Court opened a first-instance criminal trial of defendant Cao Trong Phu (born in 1962, also known as Cao Ty Phu), residing in Nghi Kim commune, Vinh city, for the crime of "Murder" and“Illegal possession and use of military weapons”.

According to the indictment, through friends, Cao Trong Phu and Mr. Dang Ngoc A. (born in 1956 - living in Ho Chi Minh City) met each other in 2019. Around May 2020, while going through divorce proceedings with his wife, Mr. A. asked Phu to buy a plot of land in Vinh City and asked Phu to be the owner of the red book because he "did not trust relatives".

In August 2020, while he was making the land title, Mr. A. asked to borrow 500 million VND from Phu. Because he had no money, Phu had to mortgage another piece of his land to the bank to get money to lend to Mr. A.

At the same time, Mr. A promised to sell Phu a SH motorbike for 100 million VND. Trusting Mr. A, Phu transferred the full amount of money, but then Mr. A did not deliver the correct motorbike as promised from the beginning. Phu asked Mr. A many times to return his money but to no avail.

After completing the land title for Mr. A., due to financial difficulties, Cao Trong Phu mortgaged Mr. A's land title to the bank to get his own land title in order to borrow more money to pay off the debt.

Since October 2020, Mr. A. has met Phu many times to demand the return of the land title. Phu clearly stated that he had mortgaged the land title to get money to lend to Mr. A. and asked for the money to be returned to him to pay the bank, but Mr. A. did not agree. From then on, the two sides had a conflict. Mr. A. continuously called and texted to threaten Phu, causing him to be psychologically depressed.

On the morning of April 30, 2021, when Phu was preparing to bring offerings to the cemetery for the ceremony, he remembered that a few days before, Mr. A. had come to his house, called and texted threatening to kill him, so he took out a K59 military pistol, which had 4 bullets, for self-defense.

At about 7:30 a.m. the same day, when Cao Trong Phu opened the gate to drive away, he saw Mr. Dang Ngoc A., Ngo Quang H. (born in 1979, residing in Vinh City) and another person in a Jeep parked right in front of his house.

Seeing Mr. A pushing the gate to enter the house, Phu stopped him. Mr. A then reached inside the gate, grabbed Phu's collar, and threatened and challenged him. Out of anger and fear that Mr. A would hire someone to kill him, Phu pulled out a gun and shot Mr. A in the chest.

Hearing the explosion, Mr. H. immediately approached Phu. Seeing a tall man wearing camouflage pants and a hat like those of the puppet army walking towards him, Phu was confused and afraid of being beaten. Phu fired two shots into the head and chest, causing Mr. H. to fall to the ground.

After shooting the two victims, Cao Trong Phu locked the gate, went into the house, and put away the gun he had used to commit the crime. At 1:30 p.m. the same day, with the encouragement of Nghe An Provincial Police, Phu surrendered and handed over the gun.

The investigation agency determined that the cause of Mr. Dang Ngoc A's death was circulatory failure and acute respiratory failure due to a bullet piercing the heart and lungs and breaking the spine.

Victim Ngo Quang H. died of a fractured and missing skull; brain contusion, cerebral hemorrhage, punctured sternum, heart, diaphragm, liver and kidney due to a bullet wound.

During the investigation, seeing that Phu's psychological development was not normal, the Nghe An Provincial Police Department issued a decision on a psychiatric examination, concluding: Before, during, and after committing the crime and at the time of the examination, Cao Trong Phu suffered from paranoid disorder, limited cognitive ability and ability to control behavior.

At the trial, the defendant confessed his crime. The defendant said that he had been repeatedly threatened by Mr. A. and that he had mental problems, so he used a gun to shoot people. The defendant apologized to the representatives of the two victims' families.

Regarding the gun used in the crime, Phu said he bought it in Ho Chi Minh City and then hid it in his house for self-defense.

The victim's representative attending the court all asked for a reduced sentence for the defendant.

Considering the case as a whole, the panel sentenced Cao Trong Phu to life in prison for “Murder” and 3 years in prison for “Illegal possession and use of military weapons”. The total sentence the defendant must receive is life in prison.
