Inter-sectoral proposal for solutions to receive and handle denunciations, crime reports and criminal cases

(Baonghean.vn) - Sectors: Procuracy, Court, Police, Border Guard, Forest Ranger, Tax, Market Management, Customs, Inspectorate discussed and agreed to sign a coordination agreement in receiving and handling denunciations and reports of crimes, recommending prosecution and resolving criminal cases.

On the morning of May 5, an online conference was held to review and evaluate the implementation results of Regulation No. 01/QCPH-LN on coordination of 9 sectors on receiving and handling denunciations, crime reports, and recommendations for prosecution; Regulation No. 02/QCPH-LN on coordination of 3 sectors in resolving criminal cases.

EVALUATION OF COOPERATION RESULTS

The conference assessed that the security, order and social safety situation in Nghe An province in recent times has remained complicated. Crimes mainly focus on drug crimes (accounting for an average of 40.3%), some cases of illegal drug trafficking and transportation in large quantities, the subjects are often reckless, reckless, using firearms, ready to fight back against the authorities when discovered and arrested. In addition, there are also types of fraud crimes via the Internet, through the form of receiving money to send people to work abroad and applying for jobs in state agencies, "black credit", human trafficking, economic crimes related to the fields of finance, banking, public asset management, basic construction investment...

From March 24, 2018 to now, the agencies have received 14,472 denunciations, crime reports and recommendations for prosecution. Of which, denunciations of crimes: 3,247; reports of crimes: 9,359; recommendations for prosecution: 37. Classification and handling results: 14,217. Of which: Criminal prosecution: 10,132. No prosecution: 3,280 (of which 2,048 were administratively handled), 171 were transferred to competent authorities for handling. Temporarily suspended: 32. Suspended: 02. Processing: 255.

The conference assessed the advantages, shortcomings, and analyzed the causes in the work of receiving and handling denunciations, reports of crimes, and recommendations for prosecution in order to propose solutions to improve the effectiveness of the work. Accordingly, attention was paid to overcoming shortcomings such as the exchange and provision of information between sectors in the process of receiving and handling information about crimes, which at times and in some places was not regular and timely. Inter-sectoral agencies sometimes failed to promptly implement regulations on notification and provision of data, and report in writing on the situation and results of receiving and handling denunciations, reports of crimes, and recommendations for prosecution.

Inter-sectoral coordination in implementing legal documents with provisions on amending and supplementing related contents; organizing professional training related to handling denunciations, reports of crimes and recommendations for prosecution need to be carried out more promptly.

Also at the conference, the three sectors of the Public Security, the Procuracy and the Court also evaluated the 3 years and 6 months of implementing Regulation No. 02/QCPH-LN dated April 23, 2018 on resolving criminal cases. In particular, the sectors focused on evaluating and agreeing to strengthen coordination in the contents of crime scene investigation, autopsy; applying, canceling or replacing preventive measures, applying search measures; coordinating in initiating, investigating, prosecuting and trying criminal cases.

According to the assessment at the conference, in general, reports with complex content and public interest were promptly directed by leaders of the sectors to be resolved. Before concluding the resolution of the source of information about crimes, the two sectors of the Public Security and the Procuracy had an official dispatch to exchange and agree on the assessment of evidence and the direction of resolution. Therefore, the prosecution or non-prosecution of the case was well-founded, in accordance with the law and minimized the possibility of criminals being missed.

After Regulation 01/QCPHLN took effect, the units that signed the regulation all seriously implemented the dissemination of the content of the Regulation to relevant professional departments, ensuring that 100% of officers and civil servants in the unit understood the content of the Regulation. Some units issued many directive documents related to the work of receiving and handling denunciations and reports of crimes, and recommendations for prosecution, in which they integrated the content of implementing the coordination regulation such as the official dispatch to strengthen solutions to increase the rate of handling crime denunciations and reports of crimes; plans on editing and publishing professional and legal guidance documents related to the work of handling denunciations and reports of crimes and criminal investigation...

PROPOSE SOLUTIONS

In addition to evaluation and summary, the sectors had 10 comments, discussed and shared work experiences, and proposed solutions to improve coordination in receiving and handling crime reports.

To increase the effectiveness of coordination between the 9 sectors, the conference proposed a number of solutions and recommendations such as maintaining meetings between sectors to promptly resolve difficulties; enhancing the exchange of information, statistics, reports and related recommendations. The investigation agency closely coordinated with the agency assigned to conduct a number of investigation activities to fully and promptly grasp the denunciations and reports of crimes and recommendations for prosecution.

In the implementation organization, the inter-sectoral agencies need to amend and supplement the coordination regulations to comply with some contents of the Criminal Procedure Code and Joint Circular No. 01/2017 of the Central Judicial Inter-sectoral Agency. At the same time, direct the district-level police investigation agency to preside over and coordinate with the district-level Procuracy to guide and inspect the implementation of preliminary verification of denunciations and reports of crimes.

The conference also requested that superior agencies pay attention to training and specialized training for officers, prosecutors, and investigators in charge of receiving and handling crime reports and recommendations for prosecution.

At the conference, the inter-sectoral agencies signed the Regulation amending and supplementing the Inter-sectoral Coordination Regulation No. 01/QCPHLN dated April 23, 2018 implementing a number of provisions of the 2015 Criminal Procedure Code on receiving and handling crime reports and recommendations for prosecution; Regulation No. 02/QCPHLN dated April 23, 2018 between the Provincial Police, the Provincial People's Procuracy and the Provincial People's Court on coordination in resolving criminal cases.
