Ministry of Health abolishes regulations that make it difficult to purchase equipment
The regulation that units must refer to the winning bid price of medical equipment within the previous 12 months; the planned price of medical equipment cannot be higher than the winning bid price has been abolished.
Deputy Minister of Health Do Xuan Tuyen has just signed and issued Circular No. 14/2022/TT-BYT abolishing a number of issued legal documents.
Some of these regulations are said to cause difficulties for medical facilities when bidding and purchasing drugs and equipment.
Specifically, Clause 3, Article 8 of Circular No. 14/2020/TT-BYT stipulates: "Medical facilities must refer to the winning bid price of medical equipment within the previous 12 months; the planned price of medical equipment must not be higher than the winning bid price...".
Talking about the shortcomings in the regulations on bidding for drugs and medical equipment and supplies, many hospital leaders said that these regulations are not consistent with the laws of market prices.

"This is impossible in reality due to the current price slide. For high-quality drugs and equipment, manufacturers/distributors will not participate in bidding if they do not have reasonable profits, leading to "rejected bidding" for many items, or if they participate in bidding, bidding prices higher than the planned price will also be marked "rejected". Low-quality, low-priced items are at risk of filling this gap" - a leader of a central hospital shared with VietNamNet.
According to Circular 14/2022 ofMinistry of HealthRecently issued, the determination of the price of medical equipment procurement packages is implemented according to Bidding Law No. 43/2013/QH13, Decree No. 63/2014/ND-CP.
For medical equipment procurement packages with approved contractor selection plans and package prices implemented according to the provisions of Clause 3, Article 8 of Circular No. 14/2020 before December 6, medical facilities shall continue to implement according to the approved contractor selection plan or carry out procedures to adjust the package price according to the provisions of Bidding Law No. 43/2013/QH13, Decree No. 63/2014/ND-CP and relevant guiding documents on package price construction of the Ministry of Finance and the Ministry of Planning and Investment.
