Tan Ky: The rate of first-time issuance of Land Use Right Certificates is low.
(Baonghean.vn) - Before the year-end meeting of the People's Council of Tan Ky district in 2022, some opinions requested an explanation for the situation of granting Land Use Right Certificates, which is still lower than planned.
Tan Ky District People's Council said that through the review report of communes and towns, in Tan Ky district there are 3,783 cases of land use but have not been granted the first Land Use Right Certificate (LURC), of which: 1,628 cases are eligible for LURC and 2,155 cases are not eligible for LURC.
The district's Department of Natural Resources and Environment said: From the beginning of the year to November 2022, the district has signed and issued 3,060 land use right certificates; of which, 2,662 are under the authority of the Tan Ky District Land Registration Office and Nghe An Provincial Land Registration Office and 398 are under the authority of the District People's Committee. Of which, 270 are first-time issuances and 128 are for changes in area. The rate of first-time issuance of land use right certificates is low, only 16.58% (270/1,268).

The reason is known, because most of the cases of applying for new land use right certificates violate land laws, administrative sanctions must be carried out before considering the preparation of land use right certificate application, which takes time and affects the progress of granting land use right certificates. Some units do not store the 299 plot map system completely, causing difficulties in the appraisal of land use right certificate application.
Some problems in the issuance of land use right certificates were identified as: overlapping of forestry land with other types of land, protection forest land being planned for production forest, unauthorized allocation without documents or records to prove, land exchanged for building schools, stations, roads... without specific guidance documents.
Another reason is that the Land Law was promulgated, accompanied by many guiding documents of the Government, the Ministry of Natural Resources and Environment, inter-ministerial, the Provincial People's Committee and documents that are changed frequently, therefore, updating and publicly posting at the One-stop department and on the electronic information portal is not timely.
Besides, the awareness and responsibility of a number of civil servants are not high, and they have many concurrent jobs.
Faced with this situation, Tan Ky district has strengthened inspection, monitoring and urging the implementation of Plan No. 815/KH-UBND of the Provincial People's Committee; focused on resolving backlogs, speeding up the progress of granting land use right certificates according to plan.
The district continues to summarize difficulties and problems in the process of granting land use right certificates and requests guidance from higher levels.
In addition, the district will improve the sense of responsibility and public ethics of cadres, civil servants and public employees in the work of preparing dossiers for granting land use right certificates; promptly detect and strictly handle cadres who cause trouble and harassment to organizations and individuals when carrying out administrative procedures on land. At the same time, rectify and monitor the implementation of receiving dossiers requesting the granting of land use right certificates at the One-stop-shop of the People's Committees of communes and towns in accordance with regulations. Continue to inspect and promptly issue conclusions on cases of land with an origin of unauthorized allocation, as a basis for considering the preparation of dossiers for granting land use right certificates according to regulations./.
