Handling of constructions that do not ensure fire prevention and fighting safety in the province

The Provincial People's Committee has just issued Official Dispatch No. 476 UBND-NC dated January 19, 2023 on handling constructions that do not ensure fire prevention and fighting safety in the province.

Accordingly, the Provincial People's Committee received Official Dispatch No. 5974/BXD-GD dated December 29, 2022 of the Ministry of Construction on instructions for handling constructions that do not ensure fire prevention and fighting safety (copy of the dispatch attached), the Provincial People's Committee requested departments, branches, the Management Board of the Southeast Economic Zone, People's Committees of districts, cities and towns according to their functions and tasks to focus on implementing a number of solutions as proposed by the Ministry of Construction, specifically as follows:

1. For constructions that do not meet fire prevention and fighting (PCCC) requirements and were put into use before Law No. 27/2001/QH10 took effect

- The Provincial Police shall preside over and coordinate with relevant departments, branches and district-level People's Committees in the implementation of Resolution No. 25/2021/NQ-HDND dated December 9, 2021 of the People's Council of Nghe An province regulating the handling of facilities that do not meet fire prevention and fighting requirements and were put into use in Nghe An province before the effective date of the Law on Fire Prevention and Fighting No. 27/2001/QH10 dated June 29, 2001, to study additional and enhanced technical solutions on fire prevention and fighting as instructed by the Fire Prevention and Fighting Police Department and Rescue - Ministry of Public Security in Document No. 1684/C01-P4 dated July 21, 2021 to advise the Provincial People's Committee to propose to the Provincial People's Council to consider, supplement and amend handling solutions to suit the actual situation of the locality (if any).

- The Provincial Police shall preside over and coordinate with provincial departments, branches, and sectors, and district-level People's Committees according to the assigned tasks in Section IV- Plan No. 41/KH-UBND dated January 21, 2022 of the People's Committee of Nghe An province, requesting investors, owners or managers of construction works to commit to remedying existing problems. The remedy process must ensure safety for people and neighboring construction works, comply with the provisions of the law on construction and other relevant laws; inspect the remedying of existing problems of investors, owners or managers of construction works. Summarize difficulties and problems in the implementation process and notify competent state management agencies for guidance, removal and adjustment to suit the practical situation.

- The Department of Construction, the Department of Specialized Construction Management, the Southeast Economic Zone Management Board, and the District People's Committee, according to their functions and tasks, shall guide and coordinate with investors, owners or managers of works to adjust architectural designs, structures, functions of works, construction permits, and construction planning related to fire prevention and fighting enhancement solutions in accordance with current regulations.

- The Department of Construction presides over and coordinates with the Provincial Police, relevant departments and branches to research, develop and organize the implementation of housing programs, urban renovation and beautification programs to gradually ensure fire prevention and fighting regulations.

2. For constructions violating fire prevention and fighting regulations that were put into use after Law No. 27/2001/QH10 took effect

- The Provincial Police shall preside over and coordinate with relevant departments, branches, and district-level People's Committees to strengthen inspection, guidance, and strictly handle violations according to the provisions of law on construction and fire prevention and fighting; at the same time, request owners or managers of construction works to organize the remediation of existing problems according to the standards, norms, and provisions of law on construction and fire prevention and fighting to ensure safety for people, property, and construction works during exploitation and use.

The Department of Construction, the Department of Specialized Construction Works Management, the Southeast Economic Zone Management Board, and the District People's Committees shall coordinate with the Provincial Police to review, research, and propose solutions to overcome cases of existing construction works that violate construction order. If necessary, report to the Provincial People's Committee or the Provincial People's Council for consideration and decision, ensuring compliance with the provisions of law.

3. Department of Construction, Department of Specialized Construction Management, Southeast Economic Zone Management Board, District People's CommitteeAccording to the authority of design appraisal, strengthen inspection, supervision and strict management of the exploitation and use of works in accordance with the approved and appraised design. In case of conversion of functions of works, it is necessary to adjust the construction design and fire prevention and fighting design in accordance with the provisions of the law on construction, the law on fire prevention and fighting and related laws; require the owner or manager of the work to maintain the work, maintain the fire prevention and fighting system and equipment in accordance with the regulations, especially for works that have been put into operation for many years to ensure safety of bearing capacity, safe operation and safety of fire and explosion prevention and fighting for the work.

4. Department of Construction, Department of Specialized Construction Management, Southeast Economic Zone Management Board in coordination with Provincial PoliceResearch and guide new contents in the National Technical Regulation QCVN 06:2022/BXD on Fire Safety for Houses and Constructions issued by the Minister of Construction with Circular No. 06/2022/TT-BXD dated November 30, 2022 to promptly guide organizations and individuals to comply with regulations.
