The Government approved the investment policy to build and operate infrastructure of Tho Loc Industrial Park.
(Baonghean.vn) - The Government has approved the investment policy for the project to invest in the construction and business of infrastructure of Tho Loc Industrial Park (phase 1) under the planning of the Southeast Nghe An Economic Zone, with VSIP Nghe An Company Limited as the investor.
Deputy Prime Minister Tran Luu Quang has just signed Decision No. 57/QD-TTg dated February 8, 2023 approving the investment policy of the Tho Loc Industrial Park infrastructure construction and business investment project (phase 1) under the planning of the Southeast Nghe An economic zone, Nghe An province. The project investor is VSIP Nghe An Company Limited.
The land use scale of the project is 500 hectares, not including the area of the North-South Expressway section through Tho Loc Industrial Park and route N2 of the Southeast Nghe An Economic Zone. The project's operating period is 50 years from February 8, 2023.

The Deputy Prime Minister requested the People's Committee of Nghe An province to direct the Management Board of the Southeast Nghe An Economic Zone to request investors to review and accurately determine the total investment capital of the project and specify it in the Investment Registration Certificate.
Regarding the project implementation location, Nghe An Provincial People's Committee directed relevant agencies to coordinate with investors to determine the location and boundaries of the project within the planning scope of Tho Loc Industrial Park approved by competent authorities and specified in the Investment Registration Certificate.
The Deputy Prime Minister requested the Ministry of Planning and Investment to take full responsibility for the project investment policy appraisal report and implement state management of industrial parks according to the provisions of the Investment Law and relevant laws.
Relevant ministries and branches are responsible for the content assigned to appraise investment projects within their functions and tasks according to the provisions of the Investment Law and relevant laws.
Nghe An Provincial People's Committee ensures the accuracy of reported information and data; appraisal contents according to the provisions of law; is responsible for the project's conformity with the planning approved by competent authorities; receives opinions from ministries and branches; updates the location and area scale of the project in the Master Plan for adjusting the General Construction Planning of Southeast Nghe An Economic Zone and the Planning of Nghe An Province for the period 2021 - 2030, with a vision to 2050, the 5-year provincial land use plan 2021 - 2025 and related construction plans and submits them to competent authorities for approval according to the provisions of the law on planning, the law on land and the law on construction.

Ensure that the project's land use targets are within the industrial park land targets in the national land use plan to 2030 and the national land use plan to 2025 allocated by the Prime Minister to Nghe An province in Decision No. 326/QD-TTg dated March 9, 2022.
Check and determine whether the investor meets the conditions for land lease by the State at the time of land lease; ensure the conditions for the State to allow the change of land use purpose to implement the project according to the provisions of the law on land.
Supervise investors to comply with construction plans approved by competent authorities, complete construction procedures according to regulations; ensure the location and scale of land use area of the project are consistent with the investment policy approved by competent authorities; the land use structure of the project and environmental safety distance comply with National Technical Regulations on construction planning and other relevant legal regulations.
At the same time, organize the development and implementation of land recovery and land use purpose conversion plans in accordance with the order, procedures and regulations of the land law, in accordance with documents approved by competent authorities on the scale, location and progress of project implementation, planning and related land use plans, and at the same time take measures to supplement land area or increase the efficiency of using other rice-growing land to compensate for the converted rice-growing land as prescribed in Clause 1, Article 134 of the Land Law.

Nghe An Provincial People's Committee directs relevant agencies and investors to comply with the provisions of the Law on Irrigation and its guiding documents; develop a plan to restore canals; ensure that the project implementation does not affect the management and operation of the irrigation system and the farming ability of people in the area; comply with the provisions of Decree No. 43/2015/ND-CP of the Government regulating the establishment and management of water source protection corridors.
In case the project implementation area has public assets, it is recommended to comply with the provisions of law on management and use of public assets, ensuring no loss of assets and state budget.
Land allocation and lease for small, narrow plots of land managed by the State must meet the criteria specified in Clause 1, Article 14a of Decree No. 43/2014/ND-CP of the Government detailing the implementation of a number of articles of the Land Law (supplemented in Clause 11, Article 1 of Decree No. 148/2020/ND-CP of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law).
The Deputy Prime Minister also requested the People's Committee of Nghe An province to direct the Management Board of the Southeast Nghe An Economic Zone and relevant agencies to supervise the project implementation process, ensuring compliance with the requirements of protecting and promoting the value of cultural heritage and the conditions prescribed by law on cultural heritage.
Guide, inspect and supervise investors in completing construction procedures according to regulations; ensure the location and scale of land use area of the project are consistent with the project investment policy approved by competent authorities, ensure the project's land use structure and environmental safety distance comply with National Technical Regulations on construction planning and other relevant legal regulations.
