The Ministry of Home Affairs proposes to increase the number of commune-level staff and 'strongly' arrange surplus personnel.
The Ministry of Home Affairs is drafting three decrees regulating policies on streamlining staff; encouraging and protecting dynamic, creative cadres who dare to think, dare to do, dare to make breakthroughs for the common good; commune-level cadres, civil servants and non-professional workers.
Proposal to increase the number of commune-level officials and civil servants
According to comrade Pham Thi Thanh Tra - Member of the Party Central Committee, Secretary of the Party Committee, Minister of Home Affairs, the development of these 3 Decrees is related to creating conditions for the arrangement of administrative units at district and commune levels in the future.
At the same time, it affirmed that 2023 and 2024 are the most concentrated time to arrange administrative units at district and commune levels, so it is necessary to fully prepare mechanisms and policies for implementation.
The Decree regulating communal-level cadres, civil servants and non-professional workers is a breakthrough. Accordingly, the number of staff at the communal level will be increased, so the Politburo must be reported to supplement this number.

Many "quite strong" policies to streamline staff
The decree regulating the policy of streamlining the payroll must integrate a number of decrees related to the policy of streamlining the payroll.
Regarding policies and regimes for redundant cadres, civil servants and public employees, the Minister said that the draft Decree sets out a "quite strong" policy so that the arrangement can be implemented immediately.
Regarding the draft Decree on encouraging and protecting dynamic, creative cadres who dare to think, dare to do, and dare to make breakthroughs for the common good, Minister Pham Thi Thanh Tra said that this is a very difficult decree, highly political.
In the context that we are actively promoting the work of preventing and combating corruption and negativity, a number of cadres have the mindset of hesitation, playing it safe, and fear of making mistakes. There needs to be mechanisms and policies for cadres to dare to think, dare to do, and dare to make breakthroughs for the common good.
Regarding the draft Decree on encouraging and protecting dynamic, creative cadres who dare to think, dare to do, and dare to make breakthroughs for the common good,consists of 3 chapters and 15 articles. It is necessary to submit it to the Government for promulgation soon to encourage cadres, civil servants and public employees to be proactive, creative, dare to think, dare to do, dare to make breakthroughs for the common good in order to institutionalize the policy in Conclusion No. 14-KL/TW dated September 22, 2021 of the Politburo.
Regarding the applicable subjects,There are two types of opinions: The first opinion applies to cadres, civil servants, and public employees holding leadership and management positions in administrative agencies, public service units, and state-owned enterprises; the second opinion applies to cadres, civil servants, and public employees working in administrative agencies, public service units, and state-owned enterprises (including cadres, civil servants, and professional and technical cadres, civil servants, and public employees not holding leadership and management positions).
On the principle of encouraging and protecting cadres,There are five principles: (1) Encourage all cadres to be proactive and creative within the scope of performing assigned duties and tasks; (2) must be carried out promptly, democratically, publicly and transparently; (3) must ensure that they do not violate the Constitution and Party Charter; (4) when damage occurs during implementation, the objective and subjective causes must be clearly identified and considered for exemption from responsibility; (5) cases of taking advantage of policies must be strictly handled.
On the draft Decree regulating streamlining of staff(replacing Decree No. 108/2014/ND-CP dated November 20, 2014, Decree No. 113/2018/ND-CP dated August 31, 2018 and Decree No. 143/2020/ND-CP dated December 1, 2020), including 5 chapters and 25 articles.
The draft has provided amended and supplemented contents on the subjects of application, cases of streamlining the payroll, policies on streamlining the payroll, early retirement policies for commune-level cadres and civil servants whose age is lower than the maximum of 10 years but more than 5 years compared to the retirement age according to the provisions of the law on social insurance, policies on streamlining the payroll for cadres, civil servants, public employees and non-professional workers at the commune level, in villages and residential groups who are redundant due to the arrangement of administrative units at the district and commune levels in the period 2023-2030 to retire immediately within 06 months from the date of the arrangement decision of the competent authority.

On the draft Decree regulating commune-level cadres, civil servants and non-professional workers at commune level, in villages and residential groups(replacing Decree No. 114/2003/ND-CP, Decree No. 92/2009/ND-CP, Decree No. 112/2011/ND-CP and Decree No. 34/2019/ND-CP), including 04 chapters and 40 articles.
The draft proposes amendments and supplements to regulations on titles, quantity, standards (competency framework) and specific tasks (job description) of each position, title of commune-level cadres, civil servants and non-professional workers at the commune level, on allowances for non-professional workers at the commune, village and residential group levels, support regimes for people directly participating in activities in villages and residential groups, allowances for part-time workers, etc.
