Land dispute, man stabbed to death

(Baonghean.vn) - Due to a dispute over forestry land between Ha and Mr. Q., the two sides had a conflict. Being chased and beaten, Ha took a knife and stabbed Mr. Q., causing the victim to die on the spot.

On May 16, Nghe An Provincial People's Court opened the first instance trial of defendant Nguyen Van Ha (born 1972), residing in Phuc Son commune, Anh Son district, for the crime ofKilling.

The case file shows that Ha and Mr. Dang Quang Q. (born in 1973) had a previous dispute over forestry land. The two sides often argued and destroyed each other's crops.

On the morning of December 15, 2022, Ha hired someone to use an excavator to dig the land to plant cassava. This land area was determined to be legally owned by Ha.

Early in the afternoon of the same day, Q. arrived at the land area and had a conflict with Ha, so he chased and beat him with a knife. Ha ran back to the camp and reported the incident to the authorities of Phuc Son commune and was instructed by the commune police to write a report.

Ha asked his wife to write a petition and then returned to the disputed area, telling Q: "You are not allowed to fence it, wait for the commune to come and resolve it." Q. replied: "I don't care, whoever touches this place I will kill." After that, Q. continued to chase and beat Ha with a knife, then returned to chop bamboo and drive stakes to make a fence.

At around 2:20 p.m., Ha took a homemade knife to the disputed land area and saw Q. still driving stakes, so he said: "Wait for the commune to come and resolve it, you can't do that." At this time, Q. replied: "No one can stop me."

When Ha pulled up the bamboo stake, Q. threw two pieces of wood in succession and hit her on the shoulder. Even though Ha ran away, Q. still chased after her with a knife and threw the knife at her opponent.

The knife fell to the ground, Q. picked it up and continued to chase and beat Ha. At this time, Ha turned around and stabbed Q. in the neck, chest, etc., causing Q. to fall to the ground and die. After committing the crime, Ha called the commune police to surrender.

At the trial, the defendant admitted to the crime. Ha said that the two sides argued and quarreled because of a land dispute. Ha stated that he did not intend to kill the victim and that the victim had spoken harshly and chased and beaten him first.

The defendant apologized to the victim and the victim's relatives, and asked the court to consider reducing the sentence.

Considering the case as a whole, the panel sentenced Nguyen Van Ha to 10 years in prison for murder. The court ordered the defendant to compensate the victim's representative 205 million VND (minus 104 million VND already paid).
