Nghe An directed to strengthen ensuring traffic order and safety in transporting goods by car.

Accordingly, implementing Directive 10/CT-TTg dated April 19, 2023 of the Prime Minister on strengthening the work of ensuring order and safety of road traffic in the new situation; the Department of Transport requests:

*Business units transporting goods by car:

- Strengthen the inspection and strict handling of drivers who violate regulations on alcohol concentration, drugs and prohibited stimulants. Require drivers to strictly comply with the law when operating vehicles.

- Regularly monitor drivers' health and strictly organize periodic health check-ups for drivers according to regulations; do not sign labor contracts with drivers who do not meet health requirements.

- Regularly organize training on transportation and traffic safety for all drivers of the unit according to regulations.

- Regularly monitor required information from the vehicle's journey monitoring device, image information from the camera installed on the vehicle when the vehicle is in operation to promptly warn and prevent violations by the driver and assistant driver (especially the following behaviors: speeding, driving continuously for too long, exceeding the working time of the day, carrying overloaded goods, exceeding the permitted size limit...), monitor, repair and promptly replace damaged journey monitoring devices and cameras installed on the vehicle.

- Regularly check and monitor the technical safety and environmental protection conditions of vehicles; urge and monitor the implementation of technical inspection, maintenance and repair regimes for vehicles; closely check and monitor the technical condition of vehicles before they are put into operation.

Strictly implement the loading of goods on cars when participating in traffic in accordance with the regulations in Circular 35/2013/TT-BGTVT of the Ministry of Transport, especially note: Implement the regulations on loading and securing goods on cars; Require the transport hirer to provide at least the following information: Characteristics of goods, size and weight of goods, bags, packages; Require the person loading goods to load goods on cars not exceeding the vehicle's allowable load and the load and size limits of bridges, tunnels, and roads on the entire freight transport route; Cover, secure, secure and support goods according to regulations and instructions of the driver and the person escorting the goods.

Fully update information on the load capacity and size limits of bridges, tunnels and roads on the entire freight transport route before transporting goods; Arrange vehicles suitable for the type of goods to be transported and the size limits of bridges, tunnels and roads on the entire transport route; Provide information to drivers, escorts and people loading goods on the characteristics of goods, size and weight of goods, bags, packages, allowable load limits of vehicles, load capacity and size limits of bridges, tunnels and roads on the entire transport route; be responsible for the information provided; Fully arrange covering, lashing and padding equipment for loading goods and create conditions for people loading goods to comply with regulations on loading goods; Instruct drivers, escorts and people loading goods on loading goods according to regulations; Direct drivers and people loading goods to coordinate with people loading goods during the process of loading, covering, lashing and supporting goods; Check the goods on the vehicle, compare with the information provided by the carrier to ensure that it does not exceed the allowable load and size limits of bridges, tunnels, and roads on the entire transport route before performing the transport task.

- Loading and unloading goods onto vehicles not exceeding the permitted traffic load stated in the Technical Safety and Environmental Protection Certificate of the vehicle receiving (returning) goods; Organizing vehicle load weighing before the vehicle enters and exits the gate (for units and facilities that require the installation of a weighing station);

- Check the implementation of regulations on loading and securing of vehicles according to Articles 4, 5, 6, 7, 8 of Circular 35/2013/TT-BGTVT. If the new regulations are met, the vehicle will leave the warehouse or yard.

- Assign a responsible person to confirm the volume of goods loaded onto the vehicle on the Transport Document or documents related to the transport of goods on the vehicle when loading is completed;

- For the export/import of raw materials and transportation of goods within the management area of ​​the unit, if the vehicles are overloaded or oversized, refuse to accept the export/import of goods and raw materials.

*Department of Transport Inspectorate:

- Strengthen inspection of freight transport business conditions of automobiles, review data of journey monitoring devices and strictly punish violations.

- Strengthen inspection of loading goods onto cars at factories, enterprises; mining units: wharves, ports, minerals, warehouses, yards; promptly handle organizations and individuals violating regulations. Detect and strictly handle cases of vehicles installed with devices that interrupt or interfere with the data transmission process of journey monitoring devices.

- Enhance discipline in public service performance; promote the prevention and fight against negativity in the management of cadres and civil servants.

*Transportation Management Department

- Strengthen the monitoring and supervision of means of transport through Journey Monitoring devices and advise on strict handling of violations of business regulations and conditions of transport business.

- Advise on revoking badges and transport business licenses for vehicles and units in accordance with the provisions of law.

- Advise on extracting journey monitoring data from the Journey Monitoring System - Vietnam Road Administration of vehicles violating legal regulations to provide to competent authorities upon request.

- Continue to urge and supervise periodic health check-ups for drivers in the transport business according to regulations.

- Enhance discipline and order in performing public duties; properly implement regulations on consulting and resolving administrative procedures, and promote the prevention and fight against negativity in the management of cadres and civil servants.

*The Department of Transport also recommends:

-Nghe An Automobile Transport Association:Strengthen propaganda and direct members to strictly comply with the provisions of the law on transportation and the contents of this document; Continue to coordinate with transport business units to organize periodic health check-ups and organize professional training for drivers and service staff on vehicles according to regulations.

- People's Committee of Vinh city and districts and towns:Directing functional forces to strengthen inspection and strictly handle organizations and individuals who violate (if any); Directing project management boards to request construction units not to use means of transport without transport business badges, vehicles violating cargo container size, overloading cargo into construction goods transportation activities. If there is a violation, terminate the contract and notify the functional forces to handle the violation according to regulations.
