Quynh Luu district proposed the People's Committee of Nghe An province to direct a comprehensive inspection of the auction process of 56 land lots in Quynh Hung commune.
(Baonghean.vn) - The People's Committee of Quynh Luu district has reviewed and re-evaluated the entire auction process of 56 land lots in Dong Quan area (Hamlet 5, Quynh Hung commune). At the same time, the district requested the Provincial People's Committee to direct a comprehensive inspection of the land auction process in this area to handle any violations according to the law.
As reported by Nghe An Newspaper, on June 20, the People's Committee of Quynh Luu district, through Quang Cong Minh Joint Stock Auction Company, conductedAuction of 56 residential plots in Dong Quan area, in Hamlet 5, Quynh Hung Commune. After the auction, the People's Committee of Quynh Luu District received a number of complaints that Mr. Nguyen Van Trong - accountant of the People's Committee of Quynh Ba Commune, is the younger brother of Mr. Nguyen Van Quy - Vice Chairman of the People's Committee of Quynh Luu District, who signed the decision approving the starting price of the land lots put up for auction. Although he was not a participant in the auction, Mr. Nguyen Van Trong still voted and was recognized by the auctioneer as the winning bidder.
After receiving the information, the People's Committee of Quynh Luu district directed the District Land Use Rights Auction Supervision Team to urgently coordinate with relevant departments and branches to verify, clarify and report to the District People's Committee for timely handling according to regulations.
On June 28, the Quynh Luu District Land Use Rights Auction Supervision Team issued Report No. 09/BC-TGS, identifying Mr. Nguyen Van Trong, the person identified by the auctioneer as the auction winner of 23 land lots in the Dong Quan planning area, Hamlet 5, Quynh Hung Commune, as the younger brother of the person who signed the decision approving the starting price of the above land lots.
Therefore, on July 11, the People's Committee of Quynh Luu district issued Decision No. 1722/QD-UBND on not recognizing the auction results of 23 residential land lots in the Dong Quan Planning Area, Village 5, Quynh Hung Commune, Quynh Luu District, Nghe An for Mr. Nguyen Van Trong.
On the same day, the People's Committee of Quynh Luu district also issued Official Dispatch No. 1519/UBND-NV to direct the Supervisory Team and the People's Committee of Quynh Ba commune to seriously review the officials and civil servants who had shortcomings in the above incident according to regulations.
In particular, because this incident caused a "stir" in public opinion, the Standing Committee of the Quynh Luu District Party Committee also requested the Quynh Luu District People's Committee to urgently carry out procedures to handle in accordance with legal regulations the land lots that were put up for auction, including 23 land lots that Mr. Nguyen Van Trong participated in the auction but violated the provisions of the law. At the same time, organize a serious review of the Land Auction Supervision Team of the District People's Committee and related organizations and individuals to clarify responsibilities and have forms of handling or propose strict handling (if violations) in accordance with the regulations of the Party and the laws of the State.
Recently, on July 20, the People's Committee of Quynh Luu district also reported on the review of the auction process of the above 56 land lots, in particular, conducted a review of related individuals and organizations. According to the People's Committee of Quynh Luu district, under the chairmanship of the Chairman of the People's Committee, a serious, frank and responsible review meeting was held for Mr. Nguyen Van Quy, Head and members of the District Land Use Rights Auction Supervision Team.
The review clearly shows that the District Land Use Rights Auction Supervision Team has made many efforts in advising on land auction supervision, the price setting process and the organization of the auction of 56 residential land lots in the Dong Quan planning area, hamlet 5, Quynh Hung commune took place objectively, in accordance with legal procedures and ensuring security and order, with no signs of fraud, collusion, or price suppression... in the auction.
However, the Supervisory Team has not organized well the supervision of the auction of the right to use 56 residential land lots in Quynh Hung commune (meeting to thoroughly grasp the situation, assigning tasks to each member of the Supervisory Team and promptly directing the handling of arising situations); the supervision of customer qualifications is not strict, leading to people who are not allowed to participate in the auction still voting and being recognized as winning the auction; 3/7 members of the Supervisory Team did not fully participate in the supervision at the voting session and announcement of the bid; when discovering that there are customers who are not allowed to participate in the auction, they are still confused and not decisive in handling the situation; the consultation on handling the results after the auction is still slow; the provision of information to the press is not timely, leading to many inaccurate information, creating bad public opinion.
Quynh Luu District People's Committee also said that the Head of the Supervisory Team and members have seriously and sincerely reviewed and learned profound lessons in performing assigned tasks in the coming time.
However, one issue that is currently troubling the People's Committee of Quynh Luu district is that Article 73 of the Law on Property Auction 2016 does not stipulate the handling of deposits for customers in case of cancellation of auction results as prescribed in Clause 1, Article 72 of the Law. Therefore, the People's Committee of Quynh Luu district has requested the Provincial People's Committee to assign the Department of Justice to guide the People's Committee of the district to handle the deposit of Mr. Nguyen Van Trong.
At the same time, the People's Committee of Quynh Luu district proposed that the Provincial People's Committee direct the Provincial Inspectorate to conduct a comprehensive inspection of the auction process of 56 residential land lots in the Dong Quan planning area, hamlet 5, Quynh Hung commune, Quynh Luu district to conclude and handle violations (if any) in accordance with the provisions of law.
