The penalties for drivers suspected of drinking alcohol but refusing to take a breathalyzer test have been included in Decree 100/2019/ND-CP with specific regulations.

Currently, to ensure traffic safety, authorities regularly set up checkpoints to check for alcohol levels. However, many vehicle owners still exhibit uncooperative attitudes and behaviors.
Accordingly, penalties for drivers suspected of having alcohol in their system have been included in Decree 100/2019/ND-CP with specific regulations.
For those who refuse to take a breathalyzer test while driving, the penalty will be 30-40 million VND according to Clause 10, Article 5 of Decree 100/2019/ND-CP.
- Driving a vehicle on the road with a blood alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.
- Refusing to comply with a request for a blood alcohol test by a law enforcement officer.
- Driving a vehicle while under the influence of drugs.
- Refusing to comply with requests for drug testing by law enforcement officers.
In addition to being fined, those who refuse to take a breathalyzer test may also face additional penalties such as having their driver's license revoked for 22 to 24 months.
Those who refuse to have their blood alcohol level measured while riding a motorcycle or moped (including electric bikes and similar types of motorcycles and mopeds) will be fined according to the provisions of Point g, Clause 8 and Point g, Clause 10, Article 6 of Decree 100/2019/NĐ-CP.
A fine of 6-8 million VND will be imposed on drivers who fail to comply with requests for alcohol level testing by law enforcement officers. In addition, the driver will have their driver's license suspended for 22-24 months.
For drivers of tractors and specialized vehicles who fail to comply with alcohol concentration testing, the penalties applied are based on Point b, Clause 9 and Point e, Clause 10 of Article 7 of Decree 100/2019/NĐ-CP.
Specifically, a fine of 16 million to 18 million VND will be imposed for failing to comply with requests for alcohol concentration testing by law enforcement officers. In addition to the fine, violators will also have their driver's license and certificate of traffic law training revoked for 22-24 months.
