Penalties for drivers suspected of drinking alcohol but refusing to have their alcohol concentration measured have been included in Decree 100/2019/ND-CP with specific regulations.

Currently, to ensure traffic safety, the authorities regularly set up checkpoints to check alcohol levels. However, many vehicle owners still have uncooperative attitudes and behaviors.

Accordingly, sanctions for drivers suspected of having alcohol concentration have been included in Decree 100/2019/ND-CP with specific regulations.

In the case of driving a car and refusing to measure alcohol concentration, there will be a fine of 30 - 40 million VND according to Clause 10, Article 5, Decree 100/2019/ND-CP:

- Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.

- Failure to comply with the request for alcohol concentration testing by an officer on duty.

- Driving on the road while having drugs in the body.

- Failure to comply with the request for drug testing by an officer on duty.

In addition to being fined, those who refuse to take a breathalyzer test will also be subject to additional penalties such as having their driver's license revoked for 22 to 24 months.

In case of driving a motorbike or moped (including electric vehicles and vehicles similar to motorbikes or mopeds) and refusing to measure alcohol concentration, the driver will be fined according to the provisions in Point g Clause 8 and Point g Clause 10 Article 6 Decree 100/2019/ND-CP.

A fine of VND 6 - 8 million will be imposed on drivers who do not comply with the request of an officer to check their alcohol level. In addition, the driver will have his/her driving license revoked for 22 - 24 months.

For tractor and specialized motorbike drivers who do not comply with alcohol concentration measurement, sanctions are applied based on Point b Clause 9 and Point e Clause 10 Article 7 Decree 100/2019/ND-CP.

Specifically, a fine of 16 million to 18 million VND will be imposed for failure to comply with the request of an officer to conduct an alcohol test. In addition to the fine, the violator will also have their driver's license and certificate of training in road traffic law revoked for 22 to 24 months.
