Reviewing the regulations on alcohol concentration violation threshold in the law
On November 24, National Assembly deputies held a discussion in the hall about the draft Law on Road Traffic Order and Safety. One of the controversial points in the draft law is the regulation on the threshold for alcohol concentration violations.

In the draft law being discussed this time, the alcohol concentration violation threshold is stipulated in Clause 1, Article 8. Accordingly, the draft stipulates that driving a vehicle while having alcohol concentration in the blood or breath is strictly prohibited.
Lawyer Nguyen Thu Trang (Hung Dao Thang Long Law Office) said that according to the draft Law on Road Traffic Order and Safety, the alcohol concentration violation threshold for traffic participants (motorbikes, cars) is at 0.
Meanwhile, Clause 8, Article 8 of the 2008 Road Traffic Law stipulates prohibited acts including:
Driving a car, tractor, or specialized motorbike on the road while having alcohol in the blood or breath.
Driving a motorbike or moped while the blood alcohol concentration exceeds 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath.
Thus, according to the provisions of the 2008 Road Traffic Law, the alcohol concentration threshold for car drivers is also 0. The alcohol concentration threshold for motorbike drivers is exceeding 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath.
Another issue that needs attention is that the current draft Law on Road Traffic Order and Safety stipulates that it is forbidden for cyclists to drive under the influence of alcohol. Many people believe that driving a bicycle at a slow speed is not too dangerous. This regulation may not be suitable for the customs and practices of many rural and mountainous areas.
