Why is it necessary to forcibly reclaim land in Hung Nguyen town to hand over to VSIP project investors?

However, in Hung Nguyen town, there are still some households that have not received compensation, affecting the overall progress of the project.

The VSIP Nghe An Industrial, Urban and Service Park Investment and Construction Project is a key investment attraction project in the province in recent years. After more than 5 years of investment and construction, this project has created a highlight with modern and standard infrastructure investment, and at the same time attracted many large foreign projects and investors to invest and develop production. In particular, in the urban area construction area, up to now, the infrastructure has been built synchronously, some roads have taken shape and are spacious.
According to research, this project has a total planned area of 750 hectares, the land acquisition area is in the communes of Hung Tay, Hung Dao, Hung Nguyen town of Hung Nguyen district and Hung Chinh commune of Vinh city. Up to now, the site clearance has been basically completed, however, there are still some households that have not received compensation, affecting the overall progress of the project and creating a bad image affecting investment attraction in the province.


In Hung Nguyen town, the project area covers an area of about 180 hectares with about 600 households having their land recovered. Of which, block 10, Hung Nguyen town has 120 households. From 2019 to present, the site clearance compensation work has been implemented by the Site Clearance Compensation Council. Hung Nguyen district People's Committee has also directed the site clearance compensation council to prepare compensation records and support affected households in accordance with the provisions of law. However, up to now, there are still 5 households in block 10 who have not received compensation to hand over the site to investors in the urban construction area, in phase 1B, 2A.1, 2A.2, 2B.3.
Mr. Cao Xuan Binh - Chairman of Hung Nguyen Town People's Committee said: After having the results of measuring and adjusting the cadastral map of this land from the beginning of 2023, on February 24, 2023, the District People's Committee issued a Notice of land recovery for affected households and individuals in Block 10. Since then, the District Land Clearance Council, the Town People's Committee, and the Block 10 Executive Committee have repeatedly organized propaganda and explained the regime and policies to the people; went to each household to mobilize to create consensus, but 5 households still did not agree, continued to have unfounded recommendations, such as: Requesting to increase the compensation price for agricultural land to 285,000 VND/m2, support career change 5 times... if these requirements are not met, no funding will be received and the premises will not be handed over.
However, according to the representative of the People's Committee of Hung Nguyen district, the people's request for this compensation price is unfounded. Because this is a project subject to the State's land acquisition as stipulated in Article 62 of the 2013 Land Law. The land price to calculate compensation when the State acquires land is the specific land price stipulated in Clause 3 and Point d, Clause 4, Article 114 of the 2013 Land Law.

After many times of propaganda and mobilization of households to comply with the current status inventory but the households still did not agree and did not cooperate, on June 7, 2023, the Chairman of Hung Nguyen District People's Committee issued Decisions on mandatory inventory of the land plots of the remaining 5 households.
In order to implement the regulations of the inventory, the Land Clearance Council of Hung Nguyen district directly notified the households about the plan, implementation time and sent the notice directly to the households. However, the households did not receive the notice and did not sign the minutes. At the same time, they did not cooperate and were not present to carry out the inventory. Therefore, the People's Committee of Hung Nguyen district was forced to issue a Decision on compulsory implementation of the Decision on compulsory inventory for 5 households and individuals on June 21, 2023.
The incident continued to drag on, although the authorities had carried out many tasks according to regulations, from counting, issuing decisions on land recovery, to notifying compensation payments, but 5 households in block 10 of Hung Nguyen town still resolutely refused to receive compensation.

Firm enforcement
In that situation, based on the provisions of law, especially for projects subject to land acquisition by the State to implement socio-economic development for national and public interests according to Clause 2, Article 62, Land Law 2013 such as this project. On October 25, 2023, the Chairman of the People's Committee of Hung Nguyen district issued Decision No. 967/QD-UBND on the establishment of a Board to enforce land acquisition for households and individuals with permanent addresses in Block 10, Hung Nguyen town. At the same time, decisions on land acquisition enforcement of households were issued according to regulations.
To ensure site clearance on schedule and timely handover of land to investors for project implementation, on November 14, 2023, the People's Committee of Hung Nguyen district issued Plan 575/KH-UBND to organize the enforcement of the decision to reclaim land from households and individuals who have not yet handed over the site in the above-mentioned area of Block 10 of Hung Nguyen town.

Accordingly, the area subject to enforcement is located on the revised Land Survey Sheet of Land Map No. 715 established by the Provincial Land Use Rights Registration Office and approved by the Department of Natural Resources and Environment on January 6, 2023. The area subject to enforcement is 16,894.5m2.2, agricultural land under the use rights of 5 households and individuals was allocated according to Decree 64/CP.
According to Mr. Cao Xuan Binh - Chairman of Hung Nguyen Town People's Committee, in parallel with carrying out the tasks assigned by the District People's Committee in Plan 575, the town will also continue to propagate and mobilize households to receive money. At the same time, fully prepare equipment, means, machinery and human resources to carry out the enforcement. The enforcement is expected to be carried out this November.
Obviously, the site clearance to hand over to the investor to implement the VSIP Nghe An Industrial, Urban and Service Park Investment and Construction Project is very necessary and urgent. This is to ensure the project is implemented on schedule, demonstrate the strictness of the law, and at the same time ensure fairness for the 115 households who agreed to receive compensation before.
