(Baonghean.vn) - On November 27, 2023, the National Assembly passed the draft Law on Identification (effective from July 1, 2024). With the name change from the Law on Citizen Identification to the Law on Identification, the citizen identification card will also have a new name, which is the ID card.

Colonel Luong The Loc - Head of the Police Department of Administrative Management of Social Order of the Provincial Police had an interview with Nghe An Newspaper reporters about issues of concern to the people.

PV:Could you please elaborate on the above issue and what is the reason for changing the name from the Citizen Identification Law to the Identification Law?

Colonel Luong The Loc:On the morning of November 27, the National Assembly passed the draft Law on Identification, replacing the 2014 Law on Citizen Identification, with 87.25% of National Assembly deputies voting in favor.

The use of the name of the Law on Identification clearly demonstrates its scientific nature, both covering the scope of regulation and subjects of application of the law, and being consistent with the trend of digital society management. With the scientific integration of information in the identification card, along with the form and method of digital management ensuring mass appeal, the name change to identification card will help make state management more scientific, serving the digital transformation, digital economy, and digital society of the Government; at the same time, creating favorable conditions and support for people to participate in social activities as well as administrative and civil transactions more and more conveniently.

PV:So,cardWhat is the difference between an ID card and a current citizen ID card?

Colonel Luong The Loc:In addition to the name, some information shown on the ID card has also been changed compared to the current citizen ID card. In particular, the words "citizen ID" have been changed to "ID", "hometown" have been changed to "place of birth registration", "place of permanent residence" have been changed to "place of residence". The ID card will no longer show fingerprints (left index finger and right index finger), the signature of the card issuer has been changed from the Director of the Department of Administrative Management of Social Order Police (C06) of the Ministry of Public Security to "Place of issue: Ministry of Public Security".

In particular, the Law on Identification stipulates that the citizen identification database includes many information fields; including identity, biometrics (facial photo, fingerprint, iris, DNA, voice), occupation (except for military, police, and cryptographic forces)... With the new regulation, in addition to the long-standing fingerprint collection, the Law on Identification has added the collection of irises in the identification information to serve as a basis for cross-checking and verifying each individual's information; providing support in cases where fingerprints cannot be collected (disabled people, deformed fingerprints, etc.).

As for DNA and voice biometric information, there will be two forms of collection. One is when people voluntarily provide it; the other is from data sharing by criminal prosecution agencies and agencies managing people subject to administrative measures.

According to the provisions of the Law on Identification, all Vietnamese citizens are issued an identification card (instead of only applying to people aged 14 and over as in the 2014 Law on Citizen Identification). Issuing identification cards to children under 14 years old is done on demand and is not mandatory.

PV:Is the issued identity card or citizen identification card still valid? Do I need to re-issue it?

Colonel Luong The Loc:According to the transitional provisions in Article 46 of the Law on Identification, all citizen identification cards issued before the effective date of this law (July 1, 2024) are still valid until the expiry date printed on the card. Citizens, when in need, can be issued a new TCC. As for identity cards that are still valid, the expiry date is December 31, 2024.

Legal documents that have been issued using information from identity cards and citizen identification cards shall retain their validity; state agencies shall not request citizens to change or adjust information on identity cards and citizen identification cards in issued documents.

For cases of using identity cards or citizen identification cards that expire before the date of issuance of identity cards (from July 1, 2024). To resolve the above situation, Clause 3, Article 46 of the Law on Identification stipulates that citizen identification cards and citizen identification cards that expire from January 15, 2024 to before June 30, 2024 will continue to be valid until June 30, 2024.

PV:So, what are the procedures and timeframe for issuing ID cards?

Colonel Luong The Loc:The issuance of identity cards is regulated in Article 23 of the Law on Identification. Specifically, people under 14 years old do so at the request of this person or their parents or guardians. For children under 6 years old, the card is issued through the public service portal; for people under 6 years old who have not registered their birth, it is done through procedures linked to birth registration on the public service portal or directly at the identity management agency. For this subject, when making an identity card, it is not necessary to collect identification features and biometric information. For children from 6 to under 14 years old, the parents or guardians directly take this person to the identity management agency to collect identification features and biometric information; Declare, sign, and carry out procedures to issue an identity card on behalf of that person.

For people 14 years of age and older:

Step 1: The recipient checks and compares information in the National Population Database… to accurately identify the person who needs the card. If there is no information, update the information in the National Population Database.

Step 2: Collect identification features and biometric information: Facial photo, fingerprints, iris of the person needing an ID card.

Step 3: The person requesting the card checks and signs the identity information receipt form.

Step 4: Receive the ID card return appointment paper. The card is returned to the location stated in the appointment paper or to another location if requested and the person must pay the delivery service fee.

Regarding the time for issuing ID cards, according to Article 26 of the Law on ID cards, the time limit for issuing, changing, and re-issuing ID cards is 7 working days from the date of receiving complete and valid documents.
