Concerning situation
Reporting to the Provincial People's Council on the management and effective use of land originating from state-owned agricultural and forestry farms and youth volunteer teams, Director of the Department of Natural Resources and Environment Hoang Quoc Viet said that Nghe An is a province with many state-owned agricultural and forestry farms and youth volunteer teams.
Land originating from state-owned agricultural and forestry farms and youth volunteer teams is mainly agricultural and forestry land, with a fairly large area; having gone through many periods of organizational changes according to the Party and State's policies, this land fund is currently managed and used by agricultural and forestry companies, forest management boards, youth volunteer teams, commune-level People's Committees, households and individuals.
Up to now, in the province, there are 11 agricultural and forestry companies managing and using according to the approved land use plan of 64,386.61 hectares. The total land area that the Provincial People's Committee has recovered from agricultural and forestry companies and handed over to local management is 12,794.36 hectares. Up to now, the Provincial People's Committee has decided to allocate and lease land to agricultural and forestry companies with an area of 26,070.9 hectares, reaching 40.5% of the total area.

Regarding the area retained according to the approved land use plan, agricultural and forestry companies directly use a part for production and business, the remaining part is assigned to households and individuals for use. The actual production model of agricultural and forestry companies is not superior to that of people in the same area.
In addition, the province has 10 protection forest management boards, 1 special-use forest management board, 2 nature reserves and 1 national park. These units are assigned to manage and use about 703,316.00 hectares of land. In the past time, the land management and use of these units basically met the requirements of the assigned tasks.
Currently, the province still has 4 youth volunteer teams operating and currently managing and using about 22,970.69 hectares of land. The land managed and used by the teams is mainly allocated in the establishment decision, there is no specific land allocation decision according to land law through the periods, and the boundary has not been marked.
Assessing the management and efficiency of land use, Director of the Department of Natural Resources and Environment Hoang Quoc Viet said that up to now, some agricultural companies have not completed the arrangement; the progress of preparing documents to request land allocation, land lease, and certification of agricultural and forestry companies is still slow.

Overlapping in land use
Land use when allocating production land between agricultural and forestry companies and people in some places is not strict, not in accordance with approved land use plans, arbitrarily converting crops and production models; there is still a situation where people illegally build permanent structures on agricultural and forestry production land.
In particular, land disputes, encroachment, and misuse of land at agricultural and forestry companies, protective forest and special-use forest management boards still occur in some units but have not been completely handled, affecting social order and safety.
The assignment of agricultural and forestry land and forest protection at some forest management units, youth volunteer teams, etc. still has many shortcomings, does not comply with regulations, and has not fully promoted the effectiveness of land resource use.
In addition, the progress of implementing the contents of the Project according to Decision No. 32/QD-TTg of the Prime Minister on boundary marking, cadastral mapping, granting land use right certificates to forest management boards, youth volunteer teams, etc. is generally slow according to the approved plan.

Analyze the cause clearly
To cause the above shortcomings and limitations, Mr. Hoang Quoc Viet said that the objective reason is that agricultural and forestry companies are subject to many different legal documents, and must simultaneously carry out many legal procedures and documents, leading to a lot of time spent preparing documents to apply for land allocation and land lease.
The area of forest and forestry land assigned to the management boards of protective forests, special-use forests, and youth volunteer teams according to the establishment decisions is very large, but the legal documents are incomplete, there are no land allocation records according to the provisions of the law on land through the periods, the boundaries and landmarks in the field have not been determined,... causing many difficulties in the work of managing and protecting forests and forestry land, especially when disputes and encroachments occur...
Regarding subjective causes, according to the Director of the Department of Natural Resources and Environment, some agricultural and forestry companies are slow to change their thinking about production and business models, have not focused on investing in advanced science and technology to improve labor productivity and land use efficiency; the process of reviewing land for separation and return to localities has not been thorough.
Some agricultural and forestry companies have not paid due attention to completing legal procedures on land; the inspection of households receiving land contracts is not strict, or even lax in some places, leading to the situation of allowing contractors to organize the construction of houses, permanent works, and use land for the wrong purposes, etc.

On the other hand, the inspection and examination of land management and use for units using land originating from agricultural and forestry farms has not been carried out regularly, so the detection and handling of violations of the law is still limited. Some district-level units have not really received proper attention in terms of human and material resources to organize the development of land use plans, land allocation, and issuance of certificates to people for land funds recovered from agricultural and forestry companies.
The annual state budget allocated to carry out boundary marking, cadastral mapping, land allocation, and issuance of land certificates for land funds managed by the Management Boards of protective forests, special-use forests, youth volunteer teams, etc. is still limited and untimely.
