Quickly and thoroughly handle problems in site clearance for the Project to Improve and Upgrade National Highway 7 through Yen Thanh

(Baonghean.vn) - Although the deadline for handing over the site to the construction units has been postponed many times to ensure progress, up to now, the Project to Renovate and Upgrade National Highway 7 through Yen Thanh District still has nearly 2km that cannot be implemented. The reason is that many households have not agreed to receive compensation.

Problems

The project to upgrade National Highway 7, section Km0 - Km36, and handle landslides caused by storms and floods in the Khe Thoi - Nam Can section, Nghe An province, started on September 7, 2022, is expected to be completed in 2023, and put into use in 2024.

At the locationYen Thanh districtNational Highway 7 has a total length of 27.774km (including both left and right sides of the route), passing through 5 communes: Vinh Thanh, Vien Thanh, Bao Thanh, Cong Thanh and My Thanh.

The People's Committee of Yen Thanh district has established the Yen Thanh District Land Acquisition and Compensation Council, and at the same time developed a compensation plan and supported land acquisition and compensation for affected people in the communes, conducted public consultations and implemented payment procedures in some localities. However, up to now, only about 25.775km/27.774km of the entire route passing through Yen Thanh district has been handed over, reaching 93%, with the remaining 1.9km yet to be handed over. This has slowed down the construction progress as planned.

According to the summary of the Land Acquisition Council of Yen Thanh district, up to this point, only Vinh Thanh commune has completed the land acquisition work. In Vien Thanh commune, there are 20/73 plots of land with a total length of 220m on both sides of the route. Of which, 9 households are not affected in terms of land but have assets affected; 8 households have not received compensation worth more than 517 million VND; and 2 households are not affected, do not meet the conditions for compensation and support but have not signed to receive the land handover.

In Bao Thanh commune, there are currently 3/33 plots of land with a length of 61m on both sides of the route, with 3 households and a total compensation value of more than 43 million VND.

In Cong Thanh commune, 16/77 plots with a total length of 195m on both sides of the route are stuck in the land clearance. Of these, 3 households are not affected by land but have assets located in the GPMB corridor; 5 households have not signed to receive compensation with a total amount of more than 497 million VND and 7 households are not eligible for compensation and support.

My Thanh commune alone has the largest number of plots of land with problems, with 53/76 plots, total length of both sides of the route is 1,565m. Of these, 3 households have assets on land under the management of the commune People's Committee; 39 households have not received compensation with a total amount of more than 4.7 billion VND; 7 households are not eligible for compensation and support and 4 households are not affected but have not yet signed the handover of the land.

The reason for the land dispute was determined to be that households did not agree with the results of the measurement to calculate the compensation value. Some households requested compensation for the increased land area (due to encroachment) and the assets on the land were not compensated (construction time after July 1, 2004). Many households and individuals also requested compensation for the land located in the road protection space due to receiving land transfer and selling without authority (when transferring, only financial obligations were performed for the area granted a Land Use Right Certificate)...

In particular, in My Thanh commune, many households requested compensation for land and assets built after July 1, 2004 on land that did not meet compensation conditions. Some households had land used before 1980, were granted land use right certificates, and had previously donated land for road construction, and now requested compensation for the donated land. Some households also did not agree with the compensation price for forestry land (production forest used since 1976) at 6,000 VND/m2and price 17,000,000 VND/m2for residential land…

It is worth mentioning that in these communes with problems, people have made petitions from the beginning and the Compensation Council for Land Acquisition and Site Clearance of Yen Thanh District has also responded in writing according to regulations. In addition, the People's Committees of the communes have also propagated and mobilized people to understand and hand over the land. However, the handover is still delayed.

Final treatment

It can be seen that the upgrading and renovation of National Highway 7 is very important for the development of the province in general and Yen Thanh district in particular. In particular, the Provincial People's Committee has repeatedly directed local authorities to promptly resolve problems and hand over the site to the contractor, ensuring the construction of the entire route, avoiding interruptions, affecting environmental sanitation and construction quality.

Specifically, on November 27, 2023, the Provincial People's Committee issued Official Dispatch No. 10146/UBND-CN on urging the progress of National Highway 7 site clearance. In particular, the province assigned the People's Committee of Yen Thanh district to approve the site clearance plan, pay the people and hand over the site to the construction unit to complete before December 15, 2023. However, because this timeline could not be met, on December 29, 2023, the Provincial People's Committee continued to issue Official Dispatch No. 11226/UBND-CN on resolving the remaining problems and difficulties related to compensation and site clearance at this project. For Yen Thanh district, the Provincial People's Committee assigned the completion of the approval of the compensation plan to pay the people and hand over the remaining clean site before January 10, 2024. However, time has passed but the site clearance to hand over the clean site to the construction unit has not been completed.

Most recently, the Provincial People's Committee also directed Yen Thanh district to complete the handover of the site in March 2024. Yen Thanh district also committed to completing the site clearance and handing over to the construction unit before March 30, 2024.

Mr. Nguyen Van Duong - Vice Chairman of Yen Thanh District People's Committee said: Currently, the district is continuing to assign communes to promote propaganda, mobilization, dialogue with people; publicly post procedures, documents, and land use records of each related household. For households that do not agree with the measurement results to calculate compensation value (because they believe that their land was previously adjacent to National Highway 7), the district is asking the Provincial People's Committee to give instructions on handling.

For households whose land was sold without authority and were granted a Land Use Right Certificate, but the affected area is within the land area of ​​the road that has not been granted a certificate, and have requested compensation and support for land and assets on the land. Although the Provincial People's Committee has agreed, many households have not provided documents and proof of having fulfilled their financial obligations, the district continues to ask for the direction of the Provincial People's Committee to implement, ensuring fairness and full rights for the people.

Mr. Duong also emphasized that to ensure the implementation of the commitment to the Provincial People's Committee, the district will resolutely and strictly handle acts of inciting people to file complaints. For cases of land acquisition and garden land that have not been handed over, or have not agreed to the compensation price according to regulations, a compulsory file will be prepared, construction protection will be established to hand over the clean site to the construction unit.
