-Using a cell phone while driving a motorbike is a violation of the Road Traffic Law. Specifically, Clause 3, Article 30 of the 2008 Road Traffic Law stipulates: “Drivers of 2-wheeled motorbikes, 3-wheeled motorbikes, and motorbikes are not allowed to perform the following acts:

a) Ride in a row;

b) Driving on the road section reserved for pedestrians and other vehicles;

c) Use of umbrellas, mobile phones, audio devices, except hearing aids;

d) Using a vehicle to pull or push other vehicles or objects, or to carry or transport bulky objects;

d) Let go of both hands or ride with one wheel for a 2-wheeled vehicle, with two wheels for a 3-wheeled vehicle;

e) Other acts that cause disorder and disrupt traffic safety…”.

- Regarding the penalty level: According to Point h, Clause 4, Article 6 of Decree 100/2019/ND-CP (amended and supplemented by Decree 123/2021/ND-CP), the act of "using mobile phones, audio devices, except hearing aids, while driving a motorbike or scooter (including electric motorbikes)" will be fined from 800,000 to 1,000,000 VND.

In addition to the fine, violators may also be subject to an additional penalty of having their driving license revoked for 1-3 months. If they cause a traffic accident, their driving license may also be revoked for 2-4 months according to Point b, Point c, Clause 10, Article 6 of Decree 100/2019/ND-CP.
