How many grams of drugs are subject to death penalty?

How many grams of drugs are subject to death penalty according to the law? The concern of Ms. Ngo Thi Hoa (Hung Nguyen, Nghe An).

Answer: Pursuant to Clause 4, Article 252 of the 2015 Penal Code, amended by Clause 69, Article 1 of the Law amending the 2017 Penal Code, it is stipulated as follows:

Accordingly, for the crime of appropriating narcotics, committing the crime in one of the following cases, the penalty is imprisonment from 15 to 20 years or life imprisonment:

- Appropriating opium resin, cannabis resin or coca extract weighing 5 kilograms or more;

- Possession of heroin, cocaine, methamphetamine, amphetamine, MDMA or XLR-11 with a weight of 100 grams or more;

- Appropriating coca leaves; khat leaves (Catha edulis leaves); leaves, roots, stems, branches, flowers, fruits of cannabis plants or other plant parts containing narcotic substances as prescribed by the Government with a weight of 75 kilograms or more;

- Appropriating dry opium fruit weighing 600 kilograms or more;

- Appropriating fresh opium fruit weighing 150 kilograms or more;

- Appropriation of other solid drugs weighing 300 grams or more;

- Appropriation of other drugs in liquid form with a volume of 750 milliliters or more;

- Appropriation of two or more narcotic substances with the total mass or volume of those substances equivalent to the mass or volume of narcotic substances specified in one of the points from point a to point g, clause 4, Article 252, Penal Code 2015, amended by clause 69, Article 1, Law amending the Penal Code 2017.

Thus, currently the highest penalty for drug appropriation is life imprisonment, not the death penalty.
