In which cases is agricultural land used for public purposes?
Ms. Nguyen Thi An, residing in Dien Chau district, asked: In what cases can agricultural land be used for public purposes according to the 2024 Land Law?
Reply:
The use of agricultural land for public purposes is clearly stipulated in Article 179 of the 2024 Land Law as follows:
1. Agricultural land funds used for public purposes that have been established in accordance with the provisions of land law over time shall continue to be used to serve the public needs of the locality.

2. Agricultural land fund used for public purposes of communes, wards and towns for the following purposes:
a) Construction of cultural, physical training, sports, public entertainment, medical, educational, market, cemetery and other public works invested, managed and used by the People's Committee at the commune level; construction of gratitude houses, charity houses and great solidarity houses;
b) Compensation for people whose land is recovered when constructing works specified in Point a, this Clause.
3. For land areas not used for the purposes specified in Clause 2 of this Article, the People's Committee at the commune level shall lease them to local individuals for agricultural production and aquaculture through auction. The land use term for each lease shall not exceed 10 years.
4. Agricultural land funds used for public purposes of communes, wards and towns shall be managed and used by the People's Committee of the commune where the land is located according to the land use planning and plans approved by competent authorities.
