Mr. Nguyen Van Toan, residing in Vinh City, asks: What does the 2024 Land Law stipulate regarding residential land in urban areas? What conditions must be met for converting residential land to land for the construction of production and business facilities?

Reply:

Urban residential land belongs to the non-agricultural land group. Article 196 of the 2024 Land Law stipulates urban residential land as follows:

1. Urban residential land is land used for housing and other purposes serving daily life within the same plot of land in an urban area.

2. Based on land availability and the actual situation of the locality, the Provincial People's Committee shall prescribe the land allocation limits for residential land to individuals in urban areas.

3. Residential land in urban areas must be planned in conjunction with land used for the construction of public works and service facilities, ensuring environmental sanitation and urban landscape.

4. The conversion of residential land to land for the construction of production and business facilities must conform to the land use plan and construction plan approved by the competent authority, and comply with the law on public order and safety, the law on environmental protection, and other relevant laws.
