Mr. Nguyen Van Toan, residing in Hoang Mai town, asks: How does the 2024 Land Law regulate the management and use of land for religious purposes?

Reply:

Article 212The 2024 Land Law stipulates the following:land of worshipas follows:

1. Religious land is land containing religious structures including communal houses, temples, shrines, ancestral halls; pagodas not covered by Clause 1, Article 213 of this Law; and other religious structures.

2. The use of land for religious purposes must be for the intended purpose and in accordance with the land use plan and construction plan approved by the competent authority.

3. The use of land for religious purposes combined with commercial and service activities must ensure compliance with the requirements stipulated in Clause 2, Article 218 of this Law.

Article 213,The 2024 Land Law stipulates the following:religious landas follows:

1. Religious land includes land for constructing religious facilities, headquarters of religious organizations, affiliated religious organizations, and other legally recognized religious structures.

2. The State allocates land free of charge for the construction of religious facilities, headquarters of religious organizations, and affiliated religious organizations.

3. The State leases land and collects annual land rent from religious organizations and affiliated religious organizations using land that does not fall under the cases specified in Clause 2 of this Article.

4. The provincial People's Committee shall, based on the actual needs of religious activities and the availability of land in the locality, regulate the limits and decide on the area of ​​land allocated to religious organizations and affiliated religious organizations in the province.

5. The use of religious land in combination with commercial and service activities must comply with the requirements stipulated in Clause 2, Article 218 of this Law.

6. In cases where the State reclaims religious land as stipulated in Clause 2 of this Article, a new location suitable to the local land resources and the religious activities of the believers shall be allocated.
