National Assembly delegates from Nghe An discuss the draft Law on People's Air Defense
On the afternoon of October 30, the National Assembly discussed in the hall a number of contents with different opinions in the draft Law on People's Air Defense. Vice Chairman of the National Assembly Tran Quang Phuong chaired the meeting.

Speaking at the discussion, regarding the case of exemption from flight licenses for drones and other flying vehicles, National Assembly member in charge of Nghe An delegation Tran Nhat Minh said that the regulation on the subjects being "drones and other flying vehicles operating outside of prohibited flying areas, restricted flying areas, operating ranges within visual range...", is still unclear.
Because according to the delegate, the visual vision of each person is different, depending on the eyesight of each person. Therefore, to have a scientific basis, the delegate suggested that it is necessary to determine the average distance of visual vision of a normal person to regulate this content more strictly, clearly, and specifically.

Regarding the content of State management of unmanned aircraft and other flying vehicles, the draft Law stipulates the "suspension and revocation of certificates or licenses of agencies, organizations, enterprises and individuals violating regulations on research, manufacture, testing, production, repair, maintenance, business, import, export, exploitation and use of unmanned aircraft and other flying vehicles".
However, according to the delegate, the draft Law has not yet specified which agency has the above authority; thereby, it is recommended that the drafting agency study and supplement in the direction that the agency with the right to grant a license has the authority to suspend or revoke the certificate or license.
Similarly, the draft Law also stipulates "revocation of licenses to operate unmanned aircraft and other flying vehicles". However, it only stipulates the authority to suspend, detain, and suppress flights, but does not stipulate the authority to revoke licenses.
“In cases where a license is suspended, detained, or restrained from flying, will the license to operate the aircraft be revoked at the same time? If the license is revoked, which agency has the authority to revoke it?” Mr. Tran Nhat Minh requested the drafting agency to clarify.
Regarding the responsibilities of local authorities at all levels, the draft Law stipulates: People's Councils at all levels, within the scope of their tasks and powers, are responsible for approving projects and plans on people's air defense. People's Committees at all levels, within the scope of their tasks and powers, perform state management on people's air defense and are responsible for submitting to the People's Councils at the same level for approval or approving within their authority projects, plans and plans on people's air defense.

Delegate Tran Nhat Minh proposed to study the suitability of this regulation for the tasks and powers of the People's Council and People's Committee at the commune level because according to the provisions of the Law on Organization of Local Government, the People's Council and People's Committee at the commune level do not have the authority to "decide on measures to implement tasks on national defense and security" like the provincial and district authorities; while people's air defense is a task in the field of national defense and security.
“On the other hand, with the current capacity and resources of the commune-level government, the draft Law stipulating that the People's Council at the commune level is assigned the task of "approving projects on people's air defense" is difficult to implement," said delegate Tran Nhat Minh.
