National Assembly Delegate of Nghe An Delegation gives opinions on regulations for influencers when advertising cosmetics and food on social networks

The draft Law amending and supplementing a number of articles of the Law on Advertising proposes that influencers who post opinions and feelings about the results of using cosmetics and food on social networks must be people who have directly used the product.

On the afternoon of November 8, the National Assembly held a group discussion. The delegation of National Assembly deputies from Nghe An province discussed in Group 3 with the delegations of National Assembly deputies from Bac Giang and Quang Ngai provinces. The discussion included Senior Lieutenant General Tran Quang Phuong - Member of the Party Central Committee, Vice Chairman of the National Assembly, and a delegate from Quang Ngai.

Regarding the draft Law amending and supplementing a number of articles of the Law on Advertising, Mr. Tran Nhat Minh - National Assembly member in charge of Nghe An delegation raised a number of opinions related to regulations on people transmitting advertising products.

Mr. Minh said that the draft law does not stipulate the rights of the person who transmits advertising products, but the content only mentions obligations, so it is recommended that it be supplemented.

The delegate of Nghe An delegation also proposed that the draft Law clearly stipulate or assign the management ministry of this field to specify the form of prior notification to consumers by the person transporting the advertising product about the fact that they are carrying out advertising activities.

He also said that it is necessary to clarify the solution to determine the behavior that the law requires for the person who transmits the product: "when posting opinions and feelings about the results of using cosmetics, health protection foods, and dietary supplements on social networks, they must be the person who directly used the product". Because if there are no specific regulations, it will be difficult to detect and handle violations.

In addition, delegates also proposed to regulate some contents on the concept of form to clearly distinguish the purpose of advertising or non-advertising.

Regarding the investment policy of the National Target Program on Drug Prevention and Control until 2030, delegate Thai Thi An Chung - Member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Nghe An proposed a more complete assessment of the results of the implementation of the Government's Drug Prevention and Control Program for the period 2021-2025; thereby having a more comprehensive picture, as a basis for building general and specific goals until 2030.

Delegates also proposed to consider raising some targets in the National Target Program on Drug Prevention and Control by 2030 such as: Number of drug-related crimes detected and arrested nationwide each year; Number of commune-level health stations nationwide qualified to determine addiction status.

The total capital proposed by the Government to be allocated for the National Target Program on Drug Prevention and Control by 2030 is more than VND 22,450 billion, of which the central budget capital accounts for the majority (78.96%). Delegate Thai Thi An Chung said that this structure is appropriate and ensures implementation; reducing pressure on provinces with difficulties in local budgets that cannot allocate large capital sources for the program.

Regarding the projects proposed in the Program, the delegate of Nghe An suggested that in addition to supporting specialized agencies in charge of drug prevention and control of the Police and Customs forces, it is necessary to consider providing additional support for drug prevention and control activities of the Border Guard, a force that plays a very important role in fighting drug crimes on the border.

Regarding the project of applying science and technology in drug prevention and control, delegate Thai Thi An Chung expressed the opinion that it would be more reasonable to review the programs and projects being implemented in this field to serve crime prevention and control in general, including drug-related crimes, so that they can be integrated.

In addition, the National Target Program on Drug Prevention and Control also proposed to implement a Project to improve the effectiveness of drug prevention and control at the grassroots level. The delegate of Nghe An delegation expressed agreement with some opinions at the group discussion that currently, the national target programs on new rural areas; socio-economic development in ethnic minority and mountainous areas also have sub-projects related to ensuring security and order at the grassroots level, including the goal of preventing and combating crime and social evils; therefore, it is recommended to review and integrate resource allocation to avoid overlap.

Agreeing with the promulgation of the National Target Program on Drug Prevention and Control until 2030, Major General Tran Duc Thuan - Standing Member of the National Assembly's Committee on National Defense and Security, delegate of Nghe An delegation, raised many opinions to contribute to the draft; in particular, he suggested assigning specific targets to local forces and authorities at all levels; and having a form of assigning responsibility to the head if the target is not achieved when the State has invested resources to implement it.

Regarding the draft Law on Chemicals (amended), Major General Tran Duc Thuan proposed to study and supplement the scope of regulation to ensure compliance with the content of the Law; specify more clearly the applicable provisions; stipulate that the chemical industry development policy must be national; list all prohibited acts; clearly define the state management role of the Ministry of National Defense...
