Proposal for preschool teachers to retire early without having their pension rate deducted

The draft Law on Education proposes that teachers in preschools, if they wish, can retire at a lower age but not more than 5 years older than the prescribed age and will not have their pension rate deducted due to early retirement.

On November 9, the National Assembly discussed the Law on Teachers in Group 3. The delegation of National Assembly deputies from Nghe An province discussed in Group 3 with the delegations from Bac Giang and Quang Ngai.

The Draft Law on Teachers consists of 9 chapters and 50 articles with many new points compared to current related laws, such as: The subjects and scope of application of the Law are teachers in educational institutions in the national education system, including teachers in public educational institutions and non-public educational institutions.

The draft Law on Teachers also has policies to standardize the teaching staff; give the education sector the initiative in recruiting and using teachers; stipulate that the recruitment of teachers must have pedagogical practice; and prioritize salary policies.

In addition, the draft Law also includes policies for teachers working in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions; policies to attract highly qualified people, talented people, excellent graduates, young scientists, and people with special talents to participate in recruitment as teachers.

The retirement age of teachers has its own regulations in accordance with the characteristics of their professional activities. In particular, teachers in preschools, if they wish, can retire at a lower age but not more than 5 years older than the regulations and will not have their pension rate deducted due to early retirement.

Teachers with the title of professor, associate professor or doctoral degree, teachers working in specific specialized fields and industries are entitled to retirement benefits at an older age.

Speaking at the discussion in the group, the National Assembly member of Nghe An delegation supported the promulgation of the Law on Teachers. Prof. Dr. Thai Van Thanh - Member of the Provincial Party Executive Committee, Director of the Department of Education and Training, delegate of Nghe An delegation highly appreciated the policies proposed in the draft Law and suggested clearly defining the central and local resources to implement the policy.

In addition, Professor Thai Van Thanh also made a number of recommendations and proposals; in which he suggested having a policy so that those who used to be teachers and lecturers when transferring to do research work at institutes and research facilities are still considered teachers; thereby ensuring the rights to strive to be recognized as associate professors and professors.

Professor Thai Van Thanh suggested that in the regulations on teachers' working regime, the work of preparing and grading teachers' papers should be added to teaching periods; at the same time, he suggested adding subjects such as high school students with excellent academic performance, achieving national and international excellent students to be given priority to attract and be directly admitted to the Pedagogical School, and excellent university graduates should be retained at the school as lecturers to contribute to improving the quality of education, training resources at all levels, grades and the entire national education system.

In particular, the delegate of Nghe An delegation suggested that the Law project should continue to be researched to have more preferential policies for preschool teachers, in addition to the priority of being able to retire at a lower age but not more than 5 years older than the regulations and not having the pension rate deducted, because preschool teachers work very hard.

Besides, although the draft Law has open regulations for foreign teachers to participate in the national education system; however, the delegate of Nghe An delegation said that the specific regulations in the laws are still vague and difficult to implement; thereby, she hopes that the drafting committee will study and provide more specific regulations.

The delegate from Nghe An also suggested a thorough review of the language to ensure it is more convincing and gain support, including regulations on the transfer of teachers in public educational institutions.

Specifically, delegates supported the mobilization of teachers due to the rearrangement of educational institutions or to resolve the surplus or shortage of teachers, or to support the improvement of the quality of teaching, education, and management of educational institutions.

However, delegate Hoang Thi Thu Hien expressed her unconvincing opinion when the draft Law also stipulates that teachers are transferred "according to the requirements and tasks of the education management agency". She suggested that there should be specific regulations for this content to avoid abuse in the transfer, creating stability and peace of mind for teachers.

In addition, delegate Hoang Thi Thu Hien also proposed passing the provisions of the Law to increase the rights and status of teachers, as well as create a favorable environment for teachers' professional activities to better protect the honor, dignity and body of teachers.

Also in the working program, the National Assembly discussed in groups the draft Law on Employment (amended). Earlier, in the morning of the same day, the National Assembly discussed in the hall the draft Resolution on piloting the handling of evidence and assets during the investigation, prosecution and trial of a number of criminal cases; listened to the presentation and examination report of the draft Law on Employment (amended); and the draft Law on Teachers.
