Nghe An issues new regulations on land rental rates and land rental rates with water surface

Nghe An Provincial People's Committee has just issued regulations on the rate (%) for calculating land rental prices, land rental prices for underground construction, and land rental prices for land with water surface in the area.

Specifically, in Decision No. 53/2024/QD-UBND dated November 11, 2024, Nghe An Provincial People's Committee proposed the following main contents:

1. Percentage (%) Calculate annual land rental price without auction: Land used for purposes belonging to the agricultural land group according to the provisions of the Land Law; land used to implement projects in investment incentive industries or special investment incentive industries; land used to implement projects in areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions according to investment law.

Accordingly, the Vinh City and Cua Lo Town area is 0.58%; Hoang Mai Town area is 0.56%; the districts of Hung Nguyen, Nam Dan, Nghi Loc, Dien Chau, Quynh Luu, Yen Thanh, Do Luong is 0.54%; the Thai Hoa Town area, Tan Ky, Thanh Chuong, Nghia Dan districts is 0.52%.

The area of ​​districts: Ky Son, Tuong Duong, Con Cuong, Que Phong, Quy Hop, Quy Chau, Anh Son is 0.5%.

Land in Economic Zones except for land for mineral exploitation projects is 0.5%;

Land for mineral exploitation projects is 1.0%.

Land for project implementation is not within the scope of the above regulations, the rest includes:

a. Vinh City:

Land plots along roads with high profitability such as Cao Thang, Tran Phu, Quang Trung, Le Loi, Minh Khai, Phan Dinh Phung, Le Huan, Hong Son are 1.25%.

Land plots along Nguyen Du, Le Duan, Mai Hac De, Nguyen Trai, Cao Xuan Huy, Thai Phien, Le Hong Phong, Phan Boi Chau, Ha Huy Tap, Nguyen Van Cu, Ho Tung Mau streets, 3-2 street, Lenin, Xo Viet Nghe Tinh, 72m street, Vinh-Cua Lo Boulevard... are 1.2%.

Land plots adjacent to roads with construction boundaries of 12m or more that do not belong to the two groups of roads mentioned above are 1.15%.

The remaining land 1.1%.

b. Cua Lo Town:

CLand plots along Binh Minh, Sao Nam, Nguyen Sinh Cung, Vinh - Cua Lo avenues are 1.2%.

The land plots along the named and unnamed planned roads in the central area, including the limits from crossroads No. 1 to No. 23 and longitudinal road No. 3 to Binh Minh Street, are 1.115%.

The remaining land plots are 1.1%.

c. Other towns:

Land plots along National Highway 48, National Highway 1A, provincial roads, Giong - Khe Son, Hung Vuong, Le Hong Phong areas in Hoa Hieu, Quang Tien, Quang Phong, Long Son wards of Thai Hoa town are 1.2%.

The remaining plots of land adjacent to the planned named and unnamed roads belong to the wards of the town, the plots of land adjacent to the national highways, provincial roads, Vuc Giong - Khe Son belong to the remaining communes, the plots of land with frontage adjacent to Ho Chi Minh road are 1.1%.

Land in the remaining locations is 1.0%.

d. Land plots along National Highway 1A, National Highway 7A, Provincial Road 538, National Highway 46, National Highway 48 in the towns of Quynh Luu, Dien Chau, Nghi Loc, Do Luong, Hung Nguyen, Nam Dan districts is 1.15%.

Land plots adjacent to National Highway 1A, National Highway 7A, Provincial Highway 538, National Highway 46, National Highway 48, Ho Chi Minh Road in the remaining towns; the remaining National Highways and Provincial Roads in the towns in the province are 1.1%.

2. Unit price for land rental for underground construction:

The land rental price for land leased by the State for the construction of underground works (not the underground part of above-ground construction works) as prescribed in Clause 1, Article 120 of the Land Law is calculated as follows:

In case of land lease with annual rent payment, the unit price is calculated at 30% of the surface land rental unit price with the form of land lease with annual rent payment for the same land use purpose.

In case of land lease with one-time land rent payment for the entire lease term, the land rent unit price is calculated at 30% of the surface land rent unit price for the form of land lease with one-time land rent payment for the entire lease term with the same purpose of use and land use term.

For land for underground construction associated with underground construction on the ground, where the underground construction area exceeds the surface land area for which land rent is collected, the land rental price payable for the excess area shall be determined according to the regulations for the above case.

3. Land rental price for land with water surface:

In the case of areas with difficult and especially difficult socio-economic conditions according to the investment law; Economic zones, land with water surface used for purposes belonging to the agricultural land group according to the provisions of the Land Law; land with water surface for projects in investment incentive sectors or special investment incentive sectors, except for land for mineral exploitation projects, the land rental price is paid annually. The land rental price paid once for the entire rental period is calculated at 30% of the annual land rental price, or the land rental price paid once for the entire rental period of the type of land adjacent to the assumption of the same land use purpose and land use term as the land area with water surface.

For cases not covered by the above regulations, the annual land rental price, one-time land rental price for the entire rental period is calculated at 40% of the annual land rental price, or one-time land rental price for the entire rental period of the land type with adjacent locations assuming the same land use purpose and land use term as the land area with water surface.

The Decision takes effect from November 21, 2024. Decision No. 70/2014/QD-UBND dated October 6, 2014 of Nghe An Provincial People's Committee issued similarly on this issue is annulled.
