National Assembly delegates propose to let press agencies decide on advertising space in print newspapers

On the afternoon of November 25, at the National Assembly House, continuing the 8th Session, the National Assembly discussed in the hall the Draft Law amending and supplementing a number of articles of the Law on Advertising.

During the discussion, 17 National Assembly deputies spoke and 1 delegate debated. The majority of National Assembly deputies highly appreciated the spirit and responsibility of the drafting agency and the agency in charge of reviewing the draft law; promptly reporting and explaining, and accepting the discussion opinions of the National Assembly deputies' groups right in the 8th Session.

The opinions expressed basically agreed and agreed on the necessity of amending a number of articles of the Advertising Law and expressed the hope that the Law would be amended and supplemented with new viewpoints and management methods, contributing to institutionalizing the Party's policies and guidelines on developing the cultural industry, including the advertising industry, overcoming the shortcomings and limitations of the current Advertising Law, contributing to building an advertising market in Vietnam that develops in line with the general development trend of advertising in the world.

Many delegates emphasized the need to ensure consistency, compatibility, and feasibility between the draft Law and specialized laws; some provisions of the Law need to be carefully assessed for impact on the basis of ensuring the rights, legitimate interests, and responsibilities of consumers and businesses, and of State management in the field of advertising such as: Regulations on advertising area in print newspapers, advertising duration in television and feature films, granting construction permits for advertising works, etc.

Regarding advertising in print newspapers, there are two opinions on this issue. However, delegate Pham Van Hoa, Dong Thap delegation proposed a third opinion and said that currently, the advertising market share in print newspapers has decreased sharply, adjusting the advertising space in print newspapers will fundamentally solve the difficulties for press agencies in practicing financial autonomy.

Therefore, delegate Pham Van Hoa proposed to study the option of removing regulations limiting the advertising area ratio in traditional newspapers and magazines so that press agencies can decide on advertising area according to readers' needs and market demand.

Regarding advertising on radio and television, there are two opinions on this issue. Delegate Pham Van Hoa said that this is a very necessary issue that we should pay attention to. He suggested assessing the impact of policies to increase persuasiveness so that advertising on television increases by 5-10%, and at the same time, it is necessary to consider when advertising is appropriate.

Regarding online advertising, the delegate said that currently there are images and advertising products that are not suitable for real life. Therefore, more attention should be paid to online advertising. Advertising service providers (including online, on film, television, and in newspapers) need to be responsible for the content of their advertising and the products they are advertising; at the same time, it is necessary to clearly and specifically define the subjects responsible for specific advertising behaviors.

Many delegates basically agreed with the addition of the concept of rights and obligations of advertising product carriers, including advertising product carriers who are influencers; at the same time, they suggested that the draft Law should have clearer regulations, separating between regular advertising product carriers and advertising product carriers who are influencers.

Delegates also expressed their opinions on the requirements for advertising content of special products and services; at the same time, some opinions suggested that special products and services should not be listed as in the draft Law, because the above products will change over time, but should be assigned to the Government to provide detailed regulations, in order to be consistent with the spirit of innovation in current law-making thinking and consistent with the characteristics of the Advertising Law...

Immediately after this session, the National Assembly Standing Committee will direct the agency in charge of the review, the drafting agency and relevant agencies to synthesize, study and absorb opinions to develop a report on the reception, explanation and completion of the draft Law to report at the next session.

On the same afternoon, the National Assembly listened to the report, the verification report and discussed in the hall about solutions to continue to remove difficulties caused by the impact of the Covid-19 pandemic so that Vietnam Airlines Corporation can soon recover and develop sustainably.
