Some tasks on organizational arrangement in Vinh city after the merger

Accordingly, the city assigned units, wards and communes to seriously, promptly and effectively implement Resolution No. 1243/NQ-UBTVQH15 on the arrangement of district and commune-level administrative units in Nghe An province, ensuring that newly formed administrative units after the arrangement come into operation from January 1, 2025.

Propaganda, dissemination and dissemination to all cadres, party members and people in the city, especially at commune-level administrative units to carry out arrangements and mergers to create high consensus and unity among cadres, civil servants, public employees, workers and people of all walks of life when organizing the implementation of Resolution No. 1243/NQ-UBTVQH15.

The requirements are: Ensure the leadership and direction of Party committees at all levels, the unified management and operation of the government, and the close coordination of the Fatherland Front and socio-political organizations at all levels.

- Ensure the continuous, effective and efficient operation of the apparatus in the political system in district and commune-level administrative units implementing the 2023-2025 arrangement; do not disrupt the lives and activities of people and the production and business activities of units and enterprises located in the area.

Specifically define the work content, deadline, completion progress and responsibilities of departments, branches, sectors, unions and localities in organizing the implementation of Resolution No. 1243/NQ-UBTVQH15 to ensure timeliness, synchronization, unity, quality and efficiency.

- Determining the content of work must be associated with functions, tasks, responsibilities and promoting the proactive and active role of departments, branches, sectors and localities; enhancing the leadership, direction and responsibility of heads of agencies, organizations and localities in the implementation process.

The city will hold a conference to announce Resolution No. 1243/NQ-UBTVQH15 in early December 2024.

Arrange and perfect the organization, apparatus and staff, civil servants, and non-professional workers in city government agencies to wards and communes:

The City prescribes the following principles of arrangement:

* Organizational structure (People's Council, People's Committee) for the new Vinh city

The arrangement and consolidation of local government organizations when arranging administrative units must ensure the principle of unity and be associated with the arrangement of organizations in the political system according to the provisions of law and the guidance of competent authorities. The organization and operation of People's Councils and People's Committees of administrative units shall comply with the provisions of Article 134 of the Law on Organization of Local Government and other relevant provisions of the National Assembly on the organization of local government. Specifically:

Advise and coordinate the arrangement and completion of the new Vinh City People's Council apparatus:Arrange and perfect the composition of the People's Council and the Committees of the new Vinh City People's Council according to the provisions of the Law on Organization of Local Government.

- Responsibility for direction: Standing Committee of City People's Council.
- Advisory responsibility: Office of the City People's Council - People's Committee.
- Coordination: Department of Internal Affairs and relevant agencies and units.

- Implementation time: Completed before December 20, 2024.

Arrange and consolidate the apparatus of specialized agencies under the Vinh City People's Committee (including 12 agencies as prescribed in Decree No. 37/2014/ND-CP dated May 5, 2014 of the Government):

- Responsibility for direction: Chairman and Vice Chairmen of the City People's Committee.

- Advisory responsibility: City Internal Affairs Department.

- Coordination of implementation: Specialized departments of the City People's Committee.

- Implementation time: Completed before December 25, 2024.

* The organizational structure (People's Council, People's Committee) of the administrative units at commune, block, and hamlet levels is formed after the arrangement:

Arrange and improve the organization of the People's Council at the commune level:

- Responsibility for direction: Standing Committee of City People's Council.
- Advisory responsibility: Office of the City People's Council - People's Committee.
- Coordination of implementation: People's Councils and People's Committees of wards and communes. To be completed before December 25, 2024.
Arrange and improve the organization of the People's Committee at the commune level:

-Responsibility for direction: Chairman and Vice Chairmen of the City People's Committee.

- Advisory responsibility: City Internal Affairs Department.
- Coordination of implementation: People's Committees of wards and communes.
- Implementation time: Completed before December 25, 2024.

Organization and operation of blocks (hamlets):
The city requires: Stabilize the organization and operation of villages and residential groups as present. In case after the arrangement of commune-level administrative units, there are blocks and hamlets with the same name in the new administrative unit, the People's Committee at the commune level shall carry out the procedure for renaming blocks and hamlets according to the provisions at Point 4, Clause 7, Article 1, Circular No. 14/2018/TT-BNV dated December 3, 2018 of the Minister of Home Affairs, amended and supplemented at Clause 2, Article 1, Circular No. 05/2022/TT-BNV dated May 23, 2022.

- For hamlets belonging to 4 communes upgraded to wards, the City People's Committee shall make a list and send it to the Department of Home Affairs for appraisal, submit it to the Chairman of the Provincial People's Committee for consideration and decision to convert it into a block according to the provisions at Point 2, Clause 7, Article 1, Circular No. 14/2018/TT-BNV dated December 3, 2018 of the Minister of Home Affairs, amended and supplemented at Clause 2, Article 1, Circular No. 05/2022/TT-BNV dated May 23, 2022.

Assignment of implementation: Vice Chairmen of the City People's Committee, City Internal Affairs Department, People's Committees of wards and communes. Vietnam Fatherland Front Committee and socio-political organizations at the same level; Party Committees, Executive Committees, Fatherland Front Working Committees of blocks and hamlets.

Implementation time for renaming blocks (hamlets), if any: Completed before December 31, 2025.

* Arrange and consolidate affiliated public service units; vertical agencies and units

About affiliated public service units:The arrangement and reorganization of public service units shall be carried out in accordance with the provisions of specialized laws, the Government's implementing guidelines (in Decree No. 120/2020/ND-CP dated October 7, 2020, Decree No. 83/2024/ND-CP dated July 10, 2024 of the Government) and relevant documents of the ministries managing the sector, field, and provincial guidelines; specifically:

- For public educational service units (all 3 levels: preschool, primary, secondary): Temporarily maintain the system of public educational service units in newly established administrative units after the arrangement.

- For public service units that have a merger policy: Carry out the process of arranging and perfecting the organizational structure (new establishment on the basis of merger) of service units under the City People's Committee and Cua Lo Town People's Committee and submit to the Department of Home Affairs and the Provincial People's Committee for decision, including: Construction Investment Project Management Board; Urban Order Management Team, Center for Culture, Sports and Communication; Cemetery Management Board; Land Fund Development Center; Agricultural Service Center. Deadline for completion before December 20, 2024.

- For units that have not yet merged: In the short term, maintain stability in organizational structure and operations; gradually research and arrange them in accordance with functions and tasks, ensuring legal regulations, including: Market Management Boards; Technical and Economic Colleges; Viet Duc Children's Cultural House; Voluntary drug rehabilitation facilities; Vocational Education - Continuing Education Center; Rescue and PCTT Center, Urban Management Board. Time to complete the arrangement: Complete before December 1, 2029.

About vertical units:The arrangement and consolidation of the organizational structure of vertical agencies and units shall be carried out in accordance with the provisions of specialized laws and instructions of the superior vertical agencies on the authority, procedures, and documents for merging and establishing agencies and units. Specifically:

- The vertical agencies of the Central Government: (1) City Police; (2) City Military Command; (3) City People's Procuracy; (4) City People's Court; (5) City Civil Judgment Enforcement Office; (6) City Statistics Office; (7) City Tax Office will carry out the merger and establishment corresponding to the integration of Cua Lo town into Vinh city.

- Vertical agencies of the province: Branch of the Land Registration Office merged and established corresponding to the merger of Cua Lo town into Vinh city.

- Medical unit system:

+ For Vinh City Medical Center (new), follow the Circular of the Ministry of Health guiding the functions, tasks, powers and organizational structure of Medical Centers of districts, towns, cities under provinces, cities under centrally-run cities when issued by the Ministry of Health.

+ For the system of medical stations in wards and communes in the city, it will be adjusted and arranged according to the adjustment and arrangement of administrative units at the commune and ward level. Implementation time: According to the general roadmap of the vertical units at the higher level.

* Arrange and assign staff (according to authority), civil servants, public employees and non-professional workers from city to ward and commune.

Requirements: Develop a plan and organize the implementation of the work of arranging, assigning and resolving the regime (including the regime and policies for redundant subjects) for the team of cadres, civil servants, public employees, workers, and part-time workers at agencies from the city to wards, communes, blocks, and hamlets when arranging and merging administrative units at all levels, ensuring compliance with legal regulations and the proposed roadmap (after 05 years from the time of the merger), according to the instructions of the Central Government, the province, and the tasks assigned in the Projects and plans of the Standing Committee of the City Party Committee.

Assignment of implementation:

- Responsibility for direction: Chairman of City People's Committee.

- Advisory responsibility: City Internal Affairs Department.

- Coordination of implementation: Request the City Party Committee's Organizing Committee, the Vietnam Fatherland Front Committee and socio-political organizations; relevant departments and units of the City; Party Committees and People's Committees of wards and communes.

- Time to develop the plan: Complete before December 1, 2024.

* Arrange the organization and staff of social organizations

a) Content: Merge and rename the association corresponding to the merger of Cua Lo town into Vinh city; the procedures and documents for merging and renaming are implemented according to the provisions of Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government regulating the organization, operation and management of associations and instructions of the Department of Home Affairs.

Based on current regulations and instructions from superior departments and branches, coordinate with the City Fatherland Front Committee to direct and guide Association organizations from the city to wards and communes in implementing the process of perfecting leadership positions, union members, association members... Implementation time: Completed before December 31, 2024.
