Regulations on settlement of cadastral records, land registration, and issuance of land use right certificates

Ms. Le Thi Hoai, residing in Con Cuong district, asked what the 2024 Land Law stipulates regarding the settlement of cadastral records, land registration, and issuance of Certificates when this law comes into effect?

Reply:

Article 256Land Law 2024 stipulatesResolving land records, land registration, and granting Certificates when this Law comes into effectas follows:

1. Paper cadastral records established before the effective date of this Law shall continue to be used for land management purposes and must be digitized during the process of establishing the national land database in accordance with the provisions of this Law.

2. The dossiers for registration of land, assets attached to land, issuance of Certificates of land use rights, ownership of houses and other assets attached to land that have been received by competent authorities but by the effective date of this Law have not been issued by competent authorities with Certificates of land use rights, ownership of houses and other assets attached to land, shall continue to be processed in accordance with the provisions of Land Law No. 45/2013/QH13 and documents detailing and guiding the implementation; the authority to issue Certificates of land use rights, ownership of assets attached to land shall comply with the provisions of this Law.

In case the land user requests to comply with the provisions of this Law, the competent authority shall resolve the matter in accordance with the provisions of this Law.

3. Certificates of land use rights, Certificates of house ownership and land use rights, Certificates of house ownership, Certificates of construction work ownership, Certificates of land use rights, house ownership and other assets attached to land that have been granted in accordance with the provisions of the law on land, the law on housing, the law on construction before the effective date of this Law are still legally valid and do not need to be changed to Certificates of land use rights and ownership of assets attached to land; in case of need, they can be changed to Certificates of land use rights and ownership of assets attached to land in accordance with the provisions of this Law.

4. In case the Certificate of land use rights, Certificate of house ownership rights and land use rights, Certificate of land use rights, house ownership rights and other assets attached to land were issued to the representative of a household before the effective date of this Law, if the members sharing the land use rights of the household have a need, they shall be issued a replacement Certificate of land use rights, ownership rights of assets attached to land and the full names of the members sharing the land use rights shall be recorded.

The determination of members sharing the right to use land of a household to register their names on the Certificate of land use rights and ownership of assets attached to the land is agreed upon by these members and they are responsible before the law.
