General Secretary To Lam, Head of the Central Steering Committee on preventing and combating corruption, waste, and negative phenomena, has just signed and issued Guideline No. 63, outlining key areas in the work of preventing and combating waste.
Seven wasteful behaviors that require focused guidance and prevention include: violations in leadership, management, and use of public finances and public assets, causing waste; wastefulness related to the development and promulgation of regulations on the management and use of public finances and public assets; and wastefulness in the management and use of the state budget.
Wastefulness in the management and use of public investment capital; in the construction, procurement, management, and use of public assets; wastefulness in the management, exploitation, and use of land and other resources; wastefulness in the management and use of state capital in investment projects under the public-private partnership (PPP) method; and state capital in enterprises.
In addition, there are other wasteful practices in the management and use of public finances and public assets as stipulated by the Party and the laws of the State.
The Central Steering Committee directly monitors and directs the handling of cases and incidents that involve multiple central ministries, departments, and agencies; provinces and centrally-administered cities; and cause serious, very serious, or exceptionally serious consequences.
Secondly, this relates to high-ranking leaders of the Party, State, and Vietnam Fatherland Front; and officials under the management of the Politburo and the Secretariat.
Thirdly, there are signs of legal violations during inspections, audits, and legal proceedings that may distort the results of investigations, prosecutions, and trials of cases; cases involving wastefulness that have already resulted in legally binding judgments and decisions but are subject to complaints, denunciations, petitions, and requests for review, causing public outrage.
Fourth, other cases and incidents involving serious and complex waste that the Central Steering Committee and its Standing Committee deem necessary to directly monitor and direct.
Furthermore, the Steering Committee for the Prevention and Combat of Corruption, Waste, and Negative Phenomena at the provincial and city levels monitors and directs the handling of complex cases and incidents of waste that attract public attention in the locality; and those involving leading and managerial officials under the management of the Standing Committee of the provincial or city Party Committee.
Cases and incidents involving serious waste, complex issues, and those attracting public attention are assigned by the Central Steering Committee, the Standing Committee of the Central Steering Committee, or are proposed by competent central agencies for provincial Party committees, city Party committees, and provincial-level Steering Committees to direct and handle.
Other cases and incidents of wastefulness that attract public attention and where local prosecuting agencies have differing opinions; cases of wastefulness that have already resulted in legally binding judgments or decisions but are subject to complaints, denunciations, petitions, or requests for review, and which attract public attention.
Cases considered for exclusion, exemption, or reduction of liability.
Organizations and individuals who commit violations and cause waste as outlined in the guidelines must be held accountable, severely punished, and required to provide compensation in accordance with the Party's regulations, the State's laws, and the regulations of the agency, organization, unit, or enterprise with state capital.
In cases where violations warrant criminal prosecution, the case file must be transferred to the relevant authorities for handling in accordance with the law; it is strictly prohibited to retain the case for internal processing.
Organizations and individuals who commit violations or cause waste due to objective reasons (violations committed in urgent situations, unexpected events, or due to objective obstacles as prescribed by law) or who have proactively detected and applied necessary measures within their authority or reported to competent authorities to prevent, handle, and remedy the consequences of the violations, acting on orders or decisions of superiors without knowing that those decisions or orders were illegal, may be considered for exclusion, exemption, or reduction of responsibility according to the regulations of the Party and the laws of the State.
