Shipper scammed to get money to pay debt

Being urged to pay his debt many times, the male shipper came up with the idea of ​​fraud. By asking customers to transfer money on their behalf, this young man defrauded a delivery business owner of nearly 30 million VND.

On June 6, Nghe An Provincial People's Court opened an appeal trial of defendant Nguyen Van Luat (22 years old, residing in Ha Tinh) for the crime of "Fraudulent appropriation of property".

The case file shows that Luat was a delivery man for a facility in Vinh City (Nghe An). Due to debt and inability to pay, this young man came up with the idea of ​​defrauding Mr. NTT (owner of a delivery facility).

On November 14, 2024, Luat texted Mr. T.'s account saying that a customer needed to transfer 30 million VND, and then he would meet the customer to receive the cash. Mr. T. agreed and agreed on the fee for receiving the money transfer.

When he learned that Mr. T. sent his employees to get the cash, Luat used deceitful tricks, saying that they had already deposited the money with him. Trusting him, Mr. T. transferred nearly 30 million VND to the account that Luat had asked his colleague to receive. Luat used the above amount to pay off all of his debts.

After discovering he had been scammed, Mr. T. reported the incident to the police. On November 15, Nguyen Van Luat turned himself in to the police and admitted to his crime.

For the crime of Fraudulent Appropriation of Property, the Court of First Instance sentenced Nguyen Van Luat to 6 months in prison. Later, Luat appealed for a reduced sentence and was given a suspended sentence.

At the appeal hearing, the defendant withdrew his appeal for a reduced sentence and maintained his appeal for a suspended sentence.

The defendant expressed remorse for his crime and explained his difficult family circumstances to ask the court for a suspended sentence.

The panel of judges determined that the defendant’s criminal acts violated the property rights of citizens protected by law, causing disorder and insecurity in society. The defendant is a person with full criminal capacity, not working hard but wanting to have money to spend and pay off debts, so he needs to be severely punished.

However, in this case, the amount of money the defendant embezzled was not large. After the incident, the defendant influenced the family to return the money to the victim. The victim filed a petition for a reduced sentence for the defendant.

The defendant has a good personal history and a clear place of residence, so it is not necessary to isolate him from society but hand him over to the local authorities for management and education.

For the above reasons, the appellate court accepted the defendant's appeal and sentenced Nguyen Van Luat to 6 months in prison with a suspended sentence for the crime of Fraudulent appropriation of property.
