The US is investigating tax fraud on a product from Vietnam, suspected to be Chinese goods 'disguised'

The US Department of Commerce (DOC) has initiated an anti-circumvention investigation into imports of disposable aluminum containers, pans, trays, and lids from Vietnam and Thailand.

The case was initiated after the Aluminum Can Manufacturers Association (AFCMA) accused businesses of the two countries of importing aluminum raw materials from China for processing and exporting to the US, in order to avoid anti-dumping and anti-subsidy taxes currently applied to Chinese goods.

Investigation process and recommendations for businesses

DOC has not yet selected a mandatory respondent but will rely on data from the US Customs and Border Protection (CBP). The preliminary determination is expected to be issued by December 4, 2025, while the final determination could be issued by May 4, 2026 or as late as July 7, 2026.

The Trade Remedies Authority of Vietnam (Ministry of Industry and Trade) recommends that relevant enterprises proactively review export activities, carefully study US legal regulations and closely coordinate with the investigation agency to protect their legitimate rights.

The products under investigation are under HS codes such as *7615.10.7125, 7615.10.3015, 7615.10.3025* and some other related codes. This is the latest move in the context of the US tightening trade control, especially with products originating from China.
